PET Authorizes Comelec to Return VCMs Pending Marcos Electoral Protest to Move Forward

The Supreme Court’s Philippine Electoral Tribunal grants the motion filed by the poll body last August and orders Comelec to “immediately conduct stripping activities for all the vote counting machines and other election materials for the timely return to Smartmatic.
The PET also directs the Comelec to expedite its complaint and “allow the parties and representatives of the Tribunal to observe and comment during the cleanup.

Return of VCMs to Smartmatic

The Commission on Elections (Comelec) starts the process of returning the vote counting machines (VCM) to Smartmatic as the Supreme Court, sitting as Presidential Electoral Tribunal (PET), disregards the plea of Bongbong” Marcos to preserve these in his protest case against Vice President Leni Robredo. This is SC’s way of speeding up the electoral protest ruling.

Rushed Stripping can Erase Data

Early on. Bongbong Marcos’ camp is in haste in seeing possibilities of erasing evidence. They doubt why Comelec defies a lawful order of the highest court just to accommodate Smartmatic. They may appear to be in a rush to turn over the VCMs to Smartmatic but perhaps necessary to move forward.




Stripped of Data

In the electoral protest, the Marcos camp opposes the return of more than 1,000 VCMs because the unused SD cards from these machines are stripped of data during a 14-hour activity at the Comelec warehouse in Sta. Rosa, Laguna as witnesses recount. They are under the protection of Pastor Boy Saycon from the Binay Camp.

SC Avoids Penalty and Moves Forward

The PET asks the Comelec for the itemized cost of the fees due to be paid to Smartmatic for the delay in the return of election equipment due to the Marcos’ protest. The Comelec claims that the damage would be P2.078 billion. Therefore, this COMELEC order serves the public welfare most of all. Unless this step is done, the next proceedings of the electoral protest cannot move forward toward a resolution to settle the Marcos-Robredo issues.
