Impeachment of Associate Justice Marvic Leonen is Delayed
Holiday Break Gave Way to Quo Warranto Petition
Deputy Speaker and Committee on Justice Senior Vice Chair Rufus Rodriguez said that the last session for this year ends on December 16. The House Speaker also needs 10 days. So, there’s no more time to hear Associate Justice Marvic Leonen’s impeachment complaint. Thus, giving way to a quo warranto petition. This is if Leonen’s detractors would want to make his removal from the SC faster.
Abusing the Process
All phases of the complaint must be determined. It is the duty of the House to make every impeachment case a priority. It won’t also allow fishing expeditions. News reports may not hold any grounds but the actual research may already be done. The original evidence is obtainable through a summon. A constitutional hearing must be in the Senate. The committee insists on its decision to go through the proceeding and prevent a quo warranto petition to happen.
Rodriguez refuses to touch on the merits of the case. He can only highlight the grounds of impeachment. Incompetence may not be a ground to impeach a magistrate. But it can be classified as culpable violation of the constitution. It seems like the filing of the case in Congress serves as a way to make a quo warranto petition stronger – just like in the case of then Chief Justice Maria Lourdes Sereno.
