Bongbong Marcos earlier said that the 2016 legal victory of the Philippines against China before a United Nations-backed arbitral tribunal. This invalidates Beijing’s expansive claim to the South China Sea creates tension with the powerful neighbor. Supreme Court Senior Associate Justice Antonio Carpio then clarifies that the joint exploration with China does not violate the constitution. This is because the Philippines is still in full control with the operation. What’s unconstitutional is the China war threat. Carpio suggests trying to change the mindset of the Chinese people that they do not own the South China Sea through international influence and social media.

Change the Mindset
Carpio reiterates his call for a more vigorous campaign to change the mindset of the Chinese that the West Philippine Sea does not belong to China. He also said that there are bills pending in Congress that push for the declaration of portions of the West Philippine Sea as a marine sanctuary.
Call for Unity to Enforce Ruling
The Social Weather Stations releases results a month ago that shows 84 percent of Filipinos want the Du30 administration to do more against China’s intrusion in the West Philippine Sea. Carpio said that 84 percent can increase at the end of the year. “That is good because it is only when we are united can we get the ruling enforced,” he said
No Legal Basis for China’s Claim
He said the Philippine government should continue to assert its rights over the West Philippine Sea. It should do something to fortify the ruling given by the Permanent Court of Arbitration in The Hague in 2016 every year. The ruling states that China has no legal basis for its nine-dash line territorial claim.
Educating the Chinese People
He also said that Filipinos should take time understanding the issues. That way, they could better explain the country’s position to other nationalities. They have the mission to convince other countries of the Philippines’ position. This is in the hope that together they could convince the Chinese people that the West Philippine Sea does not belong to them.
Downside of the Supreme Court Justice’s Plea
The Supreme Court Justice knows that China will never accept the ruling. Not unless the Chinese people realize that their historical narrative 2000 years ago is false. Since grade school to college, they have been taught that they own the South China Sea. They really believe it because they were not taught other things,” he said. However, it seems vague how the Filipinos with the help of other nations can change the mindset of over 1.3 billion people. This can actually cause more tensions between the two countries.

Nevertheless, Bongbong Marcos never ceases to give thanks on everything that goes his way. Thanksgiving might be an American tradition but Filipinos also have the culture of thanking the superior being. The former Senator’s patience on his electoral protest against the presumptive VP Leni Robredo is formidable. It seems uncertain until President Rodrigo Du30 himself appoints the new Supreme Court Chief Justice, Lucas Bersamin over the more senior, Acting Chief Justice Antonio Carpio. This time, there’s a big chance that justice can be served.

Seniority Culture of the SC
Du30 in August said he follows the “seniority” tradition at the high court when he appointed Associate Justice Teresita de Castro to replace Maria Lourdes Sereno. The President considers Sereno as his enemy. Five names were in the shortlist of chief justice aspirants drawn up by the Judicial and Bar Council.
Carpio is Set Aside
Acting Chief Justice Antonio Carpio, Associate Justices Diosdado Peralta, Estela Perlas-Bernabe, and Andres Reyes Jr. vied for the chief magistrate post. Senior Associate Justice Carpio is the most senior justice in the SC. He serves the SC since 2001. Following him is Associate Justice Diosdado Peralta who was appointed to the SC in January 2009.
Supreme Court Chief Justice Bersamin
Bersamin was a regional trial court judge in 1986 and was appointed as an SC justice in April 2009. Among the most notable cases that Bersamin penned at the SC were the ruling that granted former Sen. Juan Ponce Enrile bail due to humanitarian grounds and the decision that there was no illegal retrenchment of more than 1,000 flight attendants and stewards of the Philippine Airlines. Bersamin will retire on October 18, 2019.

Marcos urges everyone that despite the hardships in life, one must continue to give thanks. Things can only get better for as long as we are still around. He is thankful that he remains in good health and still very fit physically, mentally, and emotionally to serve the Filipino people and his beloved country, the Philippines.

The culprit is the 2016 legal victory of the Philippines against China before a United Nations-backed arbitral tribunal which invalidated Beijing’s expansive claim to the South China Sea. This created enormous tension that made the relations of both countries went sour. Thanks to Du30’s initiative, the Chinese leaders are willing to have talks on the South China Sea dispute. That leads to the signing of the MOU on oil and gas development.

Keeping an Open Mind on the South China Sea
Malacañang releases a copy of the memorandum of understanding. It is between the Philippines and China. The intention is to facilitate their cooperation in developing oil and gas resources in the West Philippine Sea. Acting Chief Justice Antonio Carpio is one of the staunchest defenders of Philippine interests in the South China Sea. He decides to keep an open mind. Carpio is a foremost expert in this issue.
In Philippine’s Terms
Carpio said that the provisions of the agreement put the Philippines in a safe position. Manila would authorize the enterprise that represents it from those with service contracts in the area. He also explains that any joint exploration should be on Philippine terms. “China proposed joint exploration but in the Constitution, the country shall have full control and supervision,” he said.
Belt and Road Initiative
Meanwhile, the “Memorandum of Understanding Between the Government of the Republic of the Philippines and the Government of the People’s Republic of China on Cooperation on the Belt and Road Initiative” deal is also formalized. It stresses the country’s intention to participate in China’s revival of the ancient Silk Road trade route.
Supporting China’s Bids
The former lawmaker expresses his support for China. He said that the country’s relations with the Asian neighbor have endured since the time of his father, the late President Ferdinand Marcos. Marcos clarifies that nobody wants war. China is very willing to have some talks too.
MOU is Designed to Resolve the Conflict
The MOU tries to settle the conflict in the South China Sea positions. It declares that all discussions and negotiations made by the two countries pursuant to the deal. There will be without prejudice to the respective legal positions of both governments.”
