Moving Forward with Bongbong Marcos to the Nation’s Progress for the Mid-term Election

The Marcos loyalists movement in Dapitan like any chapters nationwide aims to help local officials for the progress of the nation. All these initiatives are moving forward together with Inday’s Sara’s Hugpong political party, This is vital for the mid-term election in 2019 for a better and safer Philippines with more opportunities for an improved lifestyle, said Bongbong Marcos. Meanwhile, the PET denies Marcos’ motion asking for Supreme Court Associate Justice Alfredo Benjamin Caguioa’s inhibition from the case for utter lack of merit. It justifies by saying that being a Pnoy appointee does not make him bias. This is actually fair enough for as long as any future rulings in favor of Marcos won’t be blamed to the new SC Chief Justice Teresita de Castro.

Growing Family

Bongbong Marcos was filled with joy when he was invited to an induction ceremony of the Marcos Loyalist Movement. Moreover, it is the first batch of officers who are being inducted. To quote Marcos, “I was honored to join the Marcos Loyalist Movement during the induction of their inaugural batch of officers in Dapitan City, Zamboanga Del Norte,”. He also adds, “Knowing there’s a family I can count on inspires me to continue my fight for truth and genuine public service. Thank you very much for the trust!”.




Du30 – Marcos Alliance for the Mid-term Election

For the 2019 Mid-term elections, Sara Duterte is endorsing Sen, Cynthia Villar, Gov. Imee Marcos and Rep. Zajid Mangudadatu. They are among those who are also endorsed by her regional party, Hugpong ng Pagbabago. Imee Marcos believes that the Hugpong ng Pagbabago will be the voice of Mindanao. On Monday, she had formally formed an alliance with the HnP. She compares the HnP to the Solid North, the regional alliance of the Marcos Family. Like the Solid North, HnP’s approach is very local, unlike that of a traditional party.

 


The PET’s Neutrality

In a 14-page resolution dated Aug. 28, the SC, sitting as the Presidential Electoral Tribunal (PET), denied Marcos’ motion asking for Caguioa’s inhibition from the case for utter lack of merit. “The foregoing shows that Justice Caguioa’s conduct of the matters in this protest has been nothing but impartial. Further, it bears reiterating that all decisions of the Tribunal have been arrived at through majority vote of all the members of the Court sitting en banc. As provided under Rule 66 of the 2010 PET Rule,” the PET said.




En Banc Process of the Election Tribunal

Marcos earlier accused Caguioa of “evident bias and manifest partiality” in favor of Robredo. In his extremely urgent motion to inhibit, Marcos accused Caguioa of bias towards the “yellow brigade” as he took note that the magistrate has close ties with former President Benigno Aquino III.  The PET, however, rejected the motion and sternly warned” Marcos and his lawyers that “any unfounded and inappropriate accusation made in the future will be dealt with more severely.” It said that Caguioa “has been nothing but impartial” in his conduct of matters involved in Marcos’ protest against Robredo, and explained that all decisions have been reached through a majority vote of the Court en banc.




Constitutional Transition towards the New Golden Age

The current action of the PET is part of the constitutional process. This is necessary to assure the public that the decisions they make are from the en banc. Not just from a single magistrate. Since the alliance between President Du30 and Bongbong Marcos is already proven to be formidable, the Filipinos are certain that a favorable ruling on Marcos’ protest against Robredo can happen soon. It only takes time because of the constitutional processes necessary. With the emerging alliance between Imee Marcos and Sara Du30-Carpio for the upcoming election, there’s no stopping to moving forward towards the new golden age phenomenon. This growing alliance is the cause of optimism to some, and bouts of sleepless nights to others.

Atty. Glenn Chong Clarifies Bongbong Marcos’ Supreme Court Request to inhibit vs. Caguioa’s Raffle

Associate Justice Benjamin Caguioa, the member-in-charge of the namesake of former President Ferdinand Marcos’ electoral protest, writes the en banc to take the case off from him and re-raffle. The Supreme Court rejects it unanimously. On the other hand, Bongbong Marcos requests the Supreme Court to inhibit Caguioa from the case. These are two different things according to Atty. Glenn Chong. The Supreme Court’s decision to junk Caguioa’s request would mean that there is still a chance that Marcos’ plea would be favored. This is for the alleged biased magistrate to be excluded in the voting and other en banc decision makings.

The Rejected Request by the Supreme Court

The Supreme Court has unanimously rejected the request of Associate Justice Caguioa. He requested for a re-roll on who will be the member-in-charge on the poll protest after Marcos raised issues of bias.




Two Different Motions

Caguioa’s and Marcos’ requests are two different things, however, according to a court insider. Caguioa was asking for a re-raffle of the case and wrote an internal memo to ask the PET. Meanwhile, Marcos is asking the associate justice to inhibit from the entire case because of the alleged bias.

Caguioa Does Not Want to Lose Voting Rights

Caguioa is asking for a re-raffle wherein the lead would be transferred to another justice. He doesn’t want to lose his voting rights so he would not want to inhibit from the case. Whoever will be in charge will have control of the direction of the case as he will have control of the pace of the case.









Delaying Tactic?

The attacks against Caguioa according to the camp of VP Leni Robredo is just a delaying tactic. Robredo however, is appealing to apply a 25% shading threshold. This, despite the PET rejecting this earlier in favor of a 50% shading threshold. Robredo’s appeal is clearly an attempt to delay the proceedings.




Media Confusion

Some media labels the re-raffle rejection of the Supreme Court as unfortunate for Marcos. This is why Atty. Glenn Chong explains that it does not affect Marcos’ stand and progress on the protest. It can actually be beneficial because Caguioa can still lead the proceedings but could only rely on the en banc for its direction and decisions without the right to influence it or simply vote on his judgment. This is so if Marcos’ motion for Caguioa to inhibit from the protest is granted.

Many Filipinos wonder why the questionable VP is still counter-protesting Marcos when she actually fails to pay in full her counter-protest fee? This among others are the biases of the magistrate involved, said Marcos.

Anti-Bongbong Marcos Wife

The Marcos camp discovers that Caguioa’s wife is an anti-Marcos advocate. Not only that but Pier Angela Caguioa is also a staunch supporter of Leni Robredo. She has even campaigned for her in the 2016 elections actively. This is what Marcos tells the PET in a motion on the bias of Justice Caguioa against him. He also cites messages from the Viber chat group of Mrs. Caguioa.




The Conjugal Conspiracy Leak

Former Councilor Tony Boy Tabora of Baguio City has posted a video with the title “The Conjugal Conspiracy”. This has gone viral with over 312k views and 8.8k shares as of August 4, 2018. The Viber messages are documented in a video.

 

Motion to Inhibit Caguioa

To quote some of the messages from Mrs. Caguioa’s Viber chat. “If BBM wins and if he wins because of the youth, it’ll be the failure of our generation. We were the main catalysts of EDSA 1 and yet we failed to impart its lessons upon the generation that followed us” she said. Marcos also notes this in his motion. He says that this reveals the ardent support that Mrs. Caguioa has for Leni Robredo.









The Electoral Rules for the Protest

There are also rules that prohibit a justice from participation in determining the case if any member of his family is associated in the case in any manner. Furthermore, he is also aware of the fraternal bond Justice Caguioa shares with former President Benigno Aquino III. They have been classmates back from elementary until college in the Ateneo de Manila University. This bond is what made former president Aquino appoint Caguioa to the SC.




Other Biases

Marcos also cites several PET resolutions that show bias on Caguioa’s part, and caused delays on the ruling of his poll protest. A resolution issued on March 21, 2017, required him to pay P66.22 million as cash deposit for his poll protest. This resolution was received by his lawyers only on April 10, 2017, which is only a few days before holy week. He only had four days to pay half the amount else his protest would be scrapped. While on Robredo’s case, on the other hand, She still hasn’t paid the entirety of her cash deposit. Quoting Marcos, “In light of the clear and convincing evidence of bias, partiality and prejudice exhibited by Associate Justice Caguioa and Mrs. Caguioa in favor of Robredo, and the continued presence and participation of Associate Justice Caguioa as the ponente of the case are gross violations of the protestant’s Constitutional right to due process of law,” This is why Marcos appeals for public support.
