Robredo Calls Bongbong Marcos’ Speed Up Plea to Supreme Court Impractical

Bongbong Marcos’ Supreme Court motion to assign 3 hearing officers is mocked by Leni Robredo’s camp. This is for the 3 issues stated in his electoral protest. They call it impractical. It is allegedly premature for SC to hear that plea since there are still lots of priority resolutions that are pending. Most of them would delay the process which is Robredo’s ultimate intention.

[VIDEO]: The camp of former Senator Bongbong Marcos is asking the Supreme Court, sitting as the Presidential Electoral Tribunal, to designate hearing officers to assist in the conduct of the preliminary conference.



From the VP Camp

Vice President Leni Robredo camp said that the request ofBongbong Marcos to have three hearing officers in the preliminary conference on his poll protest is “impractical” and also “premature.”




Interconnected

Veteran election lawyer of the Robredo, Romulo Macalintal explained that the three causes of action presented by the Marcos camp are all interconnected. “These issues are all interconnected. It is improper for three hearing officers to resolve the said issues separately,” Macalintal argued.




Mind Conditioning

Macalintal accuses Marcos of preempting the PET’s action in filing the urgent motion. He insists that the tribunal must rule first if it sustains the 3 causes of action. “Without the preliminary conference, the motion to have three Hearing Officers is practically intended to condition the minds of the people. That has the same effect with the members of the PET. Macalintal thinks that Marcos seems to dictate the tribunal.









Stop the Delay

George Erwin Garcia, Marcos lawyer states that each cause of action presents a specific set of witness and evidence. It is better to have one separate hearing officer for each one them. The Supreme Court should have the discretion to schedule the hearings closely to each other but not at the same time – which can contradict Macalintal’s theory.

Leni Robredo’s lawyer, Atty. Romulo Macalintal mocks Bongbong Marcos for petitioning the Supreme Court or the PET to assign three hearing officers for his election protest. He also belittles him for his alleged impatience urging the SC to expedite the process. He insinuates that Marcos cannot wait to be in power.

[VIDEO]: Vice President Leni Robredo’s lawyer on Wednesday criticized former Sen. Ferdinand “Bongbong” Marcos Jr. for petitioning the Supreme Court, sitting as the Presidential Electoral Tribunal (PET), to assign three hearing officers for his poll protest.



Premature Move

Election lawyer, Macalintal describes Marcos’ move as “very premature.” Marcos’ call was apparently aimed at giving satisfaction to the public interest by giving them the answer as to where their votes went for the Vice Presidential race. The veteran lawyer mocks the action as if the 15-member PET will believe his claims before it could hear the case.




Pending Issues

Macalintal reminds the public that the PET has to decide yet if it would act on the three main issues which Marcos mentioned in his election protest. This is on top of their camp’s pending resolutions considered as their delaying tactics by Marcos’ lawyers. The high court is scheduled to take up the matter during its preliminary conference on June 21.




Urgency

Robredo’s camp throws back rumors unto Marcos that she is in a hurry to be president. The Liberal Party players are already worried of the president’s silence about Marcos in these past few months. They are suspecting that some influences are gearing up into putting him as Du30’s successor. Macalintal insinuates that Marcos is not only impatient to be Vice President but might be aiming for the presidency.









Bout for the Presidency

Do this concerns mean that Robredo is actually defending her chance to be president and not just the VP post? It is very obvious that LP members are indeed disturbed with this scenario that Marcos will eventually end up to be president sooner rather than later. Robredo’s Lawyer Reacted on Marcos’ Supreme Court Motion to Speed Up Process

Election lawyer Romulo Macalintal criticizes Marcos’ move that asks the Supreme Court to speed up the election protest process as “very premature.” He said suspiciously that it only aimed at priming the public and the 15-member PET to believe his claims that he was the real winner of the VP post before it is formally heard.

Supreme Court Motion

Bongbong Marcos asks the Supreme Court to speed up the proceedings in his election protest against Leni Robredo. Marcos suggests designating at least three hearing officers to assist the Tribunal during the preliminary conference. This is basically the content of his 7-page Urgent Ex-Parte Motion,




Ultimate Purpose

George Erwin Garcia, Marcos’ lawyer said that doing so as suggested enables hearing commissioners to facilitate better. This can result in orderly, simplified and expeditious manner. Since there are three causes of action in this election protest, it is best to have three officers as well to avoid confusion.




Unresolved Resolutions

Macalintal disagrees with Marcos’ motion because PET has yet to decide how to deal with the three main issues that Marcos included in his election protest. It also has to act on the pending resolutions they submitted. Marcos’ lawyer, Vic Rodriguez referred to them earlier as their delaying tactics.









Impractical Move

Robredo’s lawyer also thinks that it is impractical for the tribunal to grant the petition of Marcos as both parties only have one lead lawyer to handle the three major issues of Marcos’ electoral protest. “Surely, the lead lawyer has to be present in every hearing and cannot be in three places at the same time. The issues also are all interconnected. It is just improper for three hearing officers to deal with the issues separately,” Macalintal explained.

3 Issues Raised

Marcos’ protest raises the following issues:

– anomalous Automated Election System (AES);
– failure of elections in various provinces in Mindanao; and,
– the unauthorized editing by Smartmatic’s Marlon Garcia using a new hash code into the Transparency Server on election day.




Efficient Process of the Supreme Court

Marcos’ camp stressed the importance of a hearing officer assigned for each cause of action to not confuse the proceedings. Marcos intends to present witnesses and matching documentary support for each cause of action. He also added that assigning hearing officers will resolve the protest in a timely manner.




People’s Interest

Marcos stated in the resolution; “Public interest demands that this electoral controversy be resolved with dispatch to determine once and for all the genuine choice of the electorate for the contested position. Assigning 3 hearing commissioners as suggested can surely aid the Tribunal in achieving its mandate to ensure a prompt and efficient resolution for the election protest.









Not Fair for Namesake

Marcos explained this in the motion; “Moreover, it is neither fair nor just to keep in office for undetermined period one whose right to it is under suspicion. It is imperative that his claim is immediately cleared not only for the benefit of the real winner but for the sake of public interest, which can only be achieved by setting aside technicalities of procedure which can delay and complicate ordinary action.” Will the Supreme Court hear this out?

Duterte on the Lead at 36% Unofficial Count: Partial Election Result

He said that he will work for the interests of the people when officially declared as winner. He thanked all his voters and also those who did not. All votes must be counted correctly; he said.
