Ferdie Pasion: There’s No Marcos Ill-gotten Wealth but there are Many Dilawan Thieves

Political analyst Ferdie Pasion, chairman of Nat-Fil ( Nationalist Filipinos Against Foreign Intervention) said that Former First Lady and now Congresswoman, Imelda Marcos is a victim of the Dilawan’s media propaganda. Her conviction is widely announced even if it is not executory yet. He has two major questions that made his analysis logical. Were the amounts of money transferred to Swiss accounts public funds? Was Madame Marcos’ name included in the registrations of the said foundations? The 7 counts of graft cases that she found guilty of by Sandiganbayan are mere legal proceedings. Rep. Marcos is entitled to due process like everyone else. For one, she cannot steal her own wealth. In fact, it’s the Dilawans who have heavier cases of corruption, he added.

Due Process of Law

Rep. Imelda Marcos (Ilocos Norte) is allowed to avail herself of legal remedies as per the due process of law. However, the Dilawan media already made conclusions that the Marcoses have stolen wealth. In reality, “any party aggrieved by a ruling of a court can seek remedies from the court itself (i.e. motion for reconsideration) or from a higher court (appeal or certiorari).” Most news only highlights the ruling that is not yet final.


Bill of Rights

ARTICLE III, Section 1 states that: No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. This is applicable to all citizens of the country including Rep. Marcos. The Dilawans have no reason to celebrate. The amounts transferred are too large for the country’s coffer. How can it be stolen when the Philippines never had it?


Corruption Cases of the Dilawans

Pasion said that there are many more graft and corruption cases committed by the Dilawans that just went quiet. Take the case of Former president Benigno Aquino III. He may not leave the country amid a string of criminal charges he is facing over the controversial Dengvaxia vaccine. Justice Secretary Menardo Guevarra revealed that the lookout bulletin order (LBO) issued against Aquino, former health secretary Janette Garin and former budget secretary Florencio Abad Jr. stays as the DOJ has yet to resolve the charges of multiple homicide and physical injuries through negligence under the Revised Penal Code, malversation of public funds and violations of Republic Act 3019 (Anti-Graft and Corrupt Practices Act) and RA 9184 (Government Procurement Reform Act) filed against them by Volunteers Against Crime and Corruption and Vanguard of the Philippine Constitution Inc. last February. This is only one of the many offenses committed against the public.



Not Yet Executory

The anti-graft court previously ordered the arrest of Ilocos Norte Representative Marcos. However, she got her temporary freedom at Php 150,000 bail while she faces the charges against her.  She can still run for governor in the mid-term elections until the Sandiganbayan’s decision becomes final and executory but this is unlikely because the former first lady’s documentary evidence on the transactions is intact.

Imelda Marcos’ Wealth

The Sandiganbayan once convicted the former First Lady of a graft case in 1993, but the Supreme Court overturned the anti-graft court’s decision in 2003. It saved her from a 12-year prison sentence. This shows that it is impossible to legally convict a person as a thief when she can prove that the wealth in possession is their own. Therefore, the highly publicized conviction is nothing but a media propaganda by the Dilawans.

The Reason Behind Anti-Marcos Media Noise VS. Silent Reality at the Congress

The Filipino people are not anymore reliant to mainstream media news for information on major public interests. Instead, most of them exert efforts to verify facts. Recently, the noise about Former First Lady Imelda Marcos’ alleged graft conviction and bail was everywhere. It highlights that the Sandiganbayan records show that former senator Bongbong and Ilocos Norte Governor Imee Marcos were beneficiaries of the Swiss foundations earlier found to illegally exist under an unknown law. Naturally, the direct beneficiaries are the children. However, the 3rd Marcos sibling, Irene is not a politician. There’s rarely any mention of her name. Whereas the first two are strong contenders to the country’s top posts. Currently, Rep. Marcos is back to the Congress like nothing happened.

Back to the Congress

The former first lady was an early bird for the 3 pm plenary session at the Batasang Pambansa, arriving at the hall around 2:30 pm. She was wearing a pink terno-inspired long blouse and matching pants. The 89-year-old widow of the late President Ferdinand Marcos did not grant any media interviews. She was at the Congress on Monday, November 19. It was as usual.


Anti-Graft Court’s Show

On November 9, the anti-graft court Sandiganbayan found Marcos guilty of creating and maintaining private organizations in Switzerland. However, no law was cited why is this illegal. She earned at least $200 million from interest and investments for the “private benefit of the former first family. It is stressed out that the transaction is private because the deposits are privately owned.


Supreme Court’s Reversal is Expected

She was sentenced to prison for 6 years and 1 month to 11 years for each of the 7 counts of graft. Marcos, who is running for Ilocos Norte governor in 2019, can only be perpetually disqualified from holding public office if the conviction becomes executory. The Supreme Court is likely to reverse the ruling on Rep. Marcos – just like the previous dollar-salting case. The evidence was based on hearsay. Despite the documents from Swiss authorities, only two witnesses with no personal knowledge testified.



Shallow Media

An infamous yellow media even covers a Facebook post. It claims that the late Philippine President Marcos holds a Guinness World Record. That is for being the ‘Most Brilliant President in History’. Guinness did not give him such accolade, it clarified. It does list him as the one responsible for the ‘Greatest robbery of a Government,’ it added. It is odd that this publication goes to that extent of destroying the reputation of the dead. Obviously to discredit the rest of the family. These kinds of media give a bad name to journalists. They are either competing with bloggers or act as LP’s announcer.

Stopping the Marcoses’ Leadership

Meanwhile, Sandiganbayan records signify that the former senator whose electoral protest against the presumptive VP Leni Robredo is about to get a ruling from the PET for the recount on his pilot provinces. On top of that, the 80% ghost voters found in ARMM of the LP bets also made his case looks good. There’s no stopping the rising popularity of Ilocos Imee Marcos as well who is a survey favorite for Senator in the upcoming election. Many mainstream media are really desperate knowing that their faction can be wiped out soon.

Marcos Wealth: Imelda Marcos Swears to Minnie Monsod that Husband did Not Even have a Stolen Kiss

The former First Lady Imelda Marcos is still gracious at 89. She is really a beauty and brain person that made Prof. Winnie Monsod’s questions and comments sound so dumb. Provoking questions are easily corrected without ill feelings. Take the case of the alleged many boyfriends that she had – a scenario that Monsod tried so hard to insist upon. Rep. Marcos shines every time she opens her mouth. She clarifies that she has many admirers. Her transparency is just logical. However, regardless of her honesty and the kindest intention to the world, her family’s critics still insist that they have stolen some wealth from the government. This is despite the fact that her husband’s regime built the most quality public facilities in full accounting. Their wealth is just enormous for the country to have at that time. Marcos explains their gold’s origin in this video.

Transparent Even to Winnie Monsod

The elderly professor stated without thinking that Marcos’ house can collapse with the 7,000 tonnes of gold at the basement. Rep. Marcos just calmly explained that a basement is already underground. So, the weight could not possibly move the soil supporting it. She also proudly said that the first time her husband kissed her was during the wedding and it is even on the hand. No stolen kisses at all as doubted by Monsod.


Critics Insist that the Marcoses Steal

House Minority Leader Danilo Suarez expressed doubts on the veracity of reports that the Marcoses have in their possession about 7,000 tons of gold. “I don’t think we can produce that kind of tonnage from the manner by which we are mining gold,” he commented. This makes sense because Rep. Marcos said that the gold bars were already in the basement for her late husband’s house before they got married. That they multiplied because of the wise investment of his initial fee as a top-notched lawyer to a royal family. Meanwhile, detractors like Albay Rep. Edcel Lagman and Robredo urge the President not to give immunity from criminal prosecution to the Marcos family in case they surrender part or all of such wealth.


Robredo’s Poor and Rich Story

In the presumptive Vice President, Leni Robredo’s weekly program “BISErbisyong LENI” aired over the Radio Mindanao Network, Robredo said allowing Marcos provisional liberty upon posting P150,000 bail only strengthened the belief that there was a social class disparity in the country’s judicial system. Nonetheless, she keeps on accusing the Marcoses of corruption even if as a lawyer, she does not have any evidence where the wealth comes from that would support her claim.



Lovelife and Plate Number are Politicized

The Fifth Division had allowed Mrs. Marcos to post a P150,000 bail bond for her provisional liberty while her motion remains pending. This created a stir among anti-Marcos stalwarts. Therefore, they can only magnify through the media that the congresswoman’s plate number is 8. House of Representatives issued a memorandum in 2016 ordering the recall of all protocol plates previously released to lawmakers. Former speaker Pantaleon Alvarez ordered the recall of all protocol plates in the wake of reports of abuse by their users. Alvarez cited reports that certain vehicles sporting such plates have been spotted in indecent places or figured in crime-related activities. This is not different from the scandal of the late President with an American actress that was fully the work of an overseas detractor.

No Stolen Wealth

Mrs. Marcos also denied that they have stolen any wealth. In fact, in a previous interview, she accuses the PCGG of stealing from them. The cases against her were filed in 1991 and took nearly three decades of trial by several judges and prosecutors. She was once convicted of a graft case in 1993, but the Supreme Court later cleared her of any wrongdoing. That’s why there is a big possibility that all these convictions can be reversed at the SC in due time.

Will the Probable Cause Found in Junjun Binay’s Graft Case Stand in Court?

The Sandiganbayan Third Division after investigating for a long time has found probable cause to continue the case of dismissed-Makati mayor Junjun Binay for graft and falsification of public documents over the allegedly overpriced construction of the P2.2 billion Makati car park building.

Probable Cause

In a resolution released on April 18, the anti-graft court said that there was probable cause to try Binay for falsification and graft raps because he was then the head of procuring entity called HOPE who was responsible for evaluating the documents by the Bids and Awards Committee.



Falsified in Newspaper?

The court said there was a basis to proceed with the trial of Binay’s six counts of falsification of public documents. It noted that the invitation to apply for eligibility and to bid (IAETB) was allegedly falsified in the Balita newspaper by superimposing on a Sudoku game printed in a similar newspaper issue.

“Instead (of the IAETB), a Sudoku Loco game is printed in the same location where the IAETB appears in the accused’s copy. After the said examination, the Court agrees with the finding of the Ombudsman that the purported IAETB seems to have been merely superimposed in the copy of the said newspaper,” the court said in the statement.








Private Document?

Binay’s defense was rejected saying that a newspaper is a private document and he should not be liable for falsification. The court sums up that the documents only showed that Binay and his co-accused have probably committed the falsification and graft charges. This can probably lead to the prima facie records of the case that can prove that the bidding for the Makati car park building was rigged. Most of the accused including Binay have posted bail. There’s no need for the court to issue warrants for arrest.
