Tolentino vs. De Lima Recount is Now Ahead of Bongbong Marcos’ Protest against Robredo

Bongbong Marcos receives a Letter from the COMELEC to inform the parties that the Senate Electoral Tribunal already has the custody of the ballot boxes and other election documents in twenty-three pilot precincts in Basilan and Maguindanao. This is relative to the election protest of Tolentino vs. De Lima. Presidential political adviser Francis Tolentino claimed that several irregularities were uncovered in the first three days of the ongoing ballot recount. It is not clear why it went ahead of the much awaited Vice Presidential recount.

Protestant Present during Recount

Tolentino witnessed the counting at the SET building inside the Commission on Audit compound in Quezon City. The former Metropolitan Manila Development Authority chairman went to personally observe the recount of the contested 635 ballot boxes containing ballots used during the May 9, 2016, automated senatorial elections.

Recount Irregularities

He said several ballot boxes in pilot precincts in Calbayog City in Samar contained ballots that were used during the 2013 midterm elections. Tolentino said he will seek the nullification of vote results in the precincts where 2013 ballots were uncovered. The former MMDA chairman, who ran as an independent candidate, lost to De Lima by 1.2 million votes. Tolentino described De Lima’s lead over him as “dubious,” saying the gap between the 12th and 13th placers is usually just around 40,000 votes.

Another Recount to Follow

COMELEC also informed the parties that it would start to prepare for the recount of votes in the election protest of Tan vs. Hataman. Former Vice Governor Sakur Tan questions Governor Mujiv Hataman re-election victory during the 2016 polls. Therefore, the Marcos vs Robredo recount can very well be postponed for next year.

Further Delay of Marcos’ Protest

Based on the recount trend, it is evident that Marcos’ protest against Robredo is definitely not the priority of the COMELEC this year. It is then a false hope for the Marcos loyalists to expect for a recount anytime soon. This is not likely to happen considering Comelec’s publicized schedule.

SC Ruled Out Bongbong Marcos’ Election Storage Liability then Voted to Keep De Lima in Jail

It can be observed that there’s also some kind of conflict within the Supreme Court. En banc votes can judge on this. Once the so-called allies of the ex-President Aquino inhibit from a case, the Pro-administration magistrates win.  Take the case of the alleged election storage liability of Bongbong Marcos for the monthly expenses of the COMELEC warehouse in Sta. Rosa, Laguna. In its Resolution dated 29 August 2017, the PET ruled out that “there would be no occasion for the Tribunal to charge the same against either of the cash deposits of Protestant or ‘Protestee’.”

The Catch

However, there’s a catch. SC also approves COMELEC’s requests for additional time to prepare for the VP recount twice. So, the stalwarts of the previous administration seem to balance their hold to avoid public scrutiny. The ultimate goal is to delay Marcos’ Vice Presidency as their yellow comrades use Senator Leila De Lima’s plight to malign the President who is a Marcos ally.

LP can Sacrifice De Lima over Marcos’ Election

Voting 9-6, the SC en banc ruled to reject De Lima’s motion to recall her warrant of arrest. It was issued by the Muntinlupa Regional Trial Court. The six justices who dissented from the main ruling are Chief Justice Maria Lourdes Sereno, Senior Associate Justice Antonio Carpio, Associate Justices Estela Perlas-Bernabe, Alfredo Benjamin Caguioa and Francis Jardeleza.

The Administration’s Show of Power

The decision was penned by Associate Justice Presbitero J. Velasco Jr., whom de Lima had asked to inhibit from the case for allegedly pushing the acquittal of a New Bilibid Prison (NBP) drug lord.

Criminal Charges

The Department of Justice (DOJ) in February filed three criminal charges against De Lima for supposedly receiving bribes from NBP drug lords in exchange for their protection during her term as Justice secretary. The agency also accused De Lima of using the money from the illegal drug trade to fund her 2016 senatorial campaign. She was charged with three counts of violation of Section No. 5 of the Comprehensive Dangerous Drugs Act of 2002 in relation to trafficking and criminal liability of government officials.  Contrary to the black media propaganda against the President, De Lima is not a political prisoner.

Media Propaganda Affects People but Love Remains for Marcos and Du30

Thee love of the majority of Filipinos for President Rodrigo Du30 remains just like with the Marcoses. This is despite the decline in his net satisfaction and trust ratings, according to Palace spokesman Ernesto Abella. Bongbong Marcos earlier expresses his disagreement to control social media. He explained that it can actually neutralize biased mainstream media reports. The Marcoses has suffered more than 30 years of misinformation after his father, the late Ferdinand Marcos stepped down in 1986. Media propaganda causes his popularity to decline. Just like what Du30’s detractors are hoping for.

Ratings Dropped

Abella explains that the drop in the President’s net satisfaction ratings was expected since the “honeymoon period” for the administration has now ended. “The change in the President’s satisfaction rating, from 78 percent in June to 67 percent in September, and trust rating, from 82 percent in June to 73 percent in September, is normal given the fact that people start measuring their expectations usually after the honeymoon period, or after a year in office,” Abella said this through a press briefing in Malacañang.

Public Trust is Good

In spite of this, however, Abella believed that public satisfaction remains “good” and public trust remains “very good”. Social Weather Stations (SWS) conducted the non-commissioned survey from September 23 to 27. Those were days after the nationwide rally held on September 21 – the National Day of Protests.  The Liberal Party-inspired groups protested the alleged street killings and alleged human rights violations in Luneta. They blamed the administration’s drug war for all the killings. These include crimes of passion, feud among illegal drug criminals, and personal rifts or grudges. However, the pro-administration supporters were bigger in number. They rallied to show their support to the President in a bigger historical vicinity at Plaza Miranda.

Survey Period

“It is worth noting that surveys are snapshots of the public mood at a given time and the SWS survey was conducted between September 23-27, just 2 days after the National Day of Protest – the bold initiative of the President allowed citizens to freely vent their grievances about the excesses and shortcomings of the government. Some sentiments may have spilled over,” Abella added. The LP cannot accuse his administration anymore of suppressed freedom of speech. The leader did learn from Marcos’ plight.

Love Begets Love

Nevertheless, “the love is still there,” Abella added.   The Palace official assured the public that the government would “continue to work harder to address the public’s urgent needs in order to bring a comfortable life for all.”   “We enjoin everyone to set aside self-interest and together build a nation worthy of the next generation,” Abella said. Biased media often interview only the sides that support their interests. In the video, Senator Leila de Lima, of course, did not admit that her own lover and bodyguard has a signed affidavit of her involvement with the drug trade that put her in prison. Emotional family members of some fatalities are also featured to solicit condemnation geared towards the president even if they are isolated cases or victims of other social problems that are in existence since time immemorial like the communist insurgents’ kidnap for ransom activities.

The Most Vocal Liberal Party Senator Dismayed over Gina Lopez’s CA Rejection

The most vocal Liberal Party senator, Senator Leila de Lima never gave the president credit for anything. But when it comes to Gina Lopez as DENR Secretary, she admits that he chose the right woman for the job. She is obviously dismayed saying that it was too bad that Du30 was unable to keep Lopez in the DENR post.

Liberal Party’s Bet

Senator Franklin Drilon echoed the sentiments of Senator de Lima and also discloses that he and most Liberal Party senators voted in favor of Lopez. It is just unfortunate that they do not have enough number for her to be confirmed as DENR Secretary.

Not Surprised

De Lima said that She cannot say that she is surprised.  These days, it isn’t any more surprising to see men and women of the strongest conviction—who have the moral courage to stand up for what is right be rejected, she said. They can be undermined and even be subjected to unfair attacks by a method run by vested interests, she added.

System Failure

The senator is convinced that there are forces in the government that even the president cannot risk undermining. In spite of all his threats the destruction of the environment by mining companies, he can do nothing to install a passionate DENR chief. She assures Lopez that it was not her failure but the system malfunction.

LP Votes

Aside from Drilon, most Liberal Party senators also voted for Lopez. Kiko Pangilinan, Ralph Recto, and Bam Aquino admit to it. Other names are not known unless they divulge it themselves. This is allowed according to the confidentiality rule that takes away pressure from CA committee members to vote according to their conscience.

The European Parliament adopts the call of a lawmakers’ group to immediately release detained Philippine Senator Leila de Lima. She is the fiercest critic of Philippine President. In a resolution, it firmly asks for her to be provided with adequate security while in jail. Filipinos are confused why an international body dares to interfere with the country’s legal system just to protect a notorious illegal drugs trade coddler?

Due Process

On top of that, European lawmakers urge the Philippine authorities “to ensure a fair trial. It even recalls the right to the presumption of innocence. It demands the government to drop all politically motivated charges against her. They also ask the government to end any further acts of harassment. As if she’s not capable of any wrongdoings. This is a clear manifestation of misinformation.

Death Penalty Say

In the same resolution, the EU tells Philippine officials to “immediately halt ongoing proceedings to reinstate the death penalty.” Do they have the right to do so? Can’t they understand that the Philippine government is capable enough to do its mandate to properly govern the country? What’s wrong with this people? Filipinos elected a leader who vows to declare war on drugs. They should respect that.

Display of Arrogance

Senate Majority Leader Vicente “Tito” Sotto III thinks that for the European Parliament to call for Senator Leila de Lima’s release clearly displays their arrogance. “The European Parliament must be told that the Philippines is a democratic nation ruled by law. Judicial processes are fully functioning,” Sotto said. Their demanding the release of Senator De Lima is a display of arrogance. They want to show power. Pure interference in the country’s domestic affairs cannot be tolerated.


Note Verbale of Protest

Sotto then urges the Philippine embassy in EU Capital to file a protest and explain De Lima’s case. “Our embassy in EU Capital must file a Note Verbale of Protest and explain in full the case of Senator Leila,” he said.“The Department of Foreign Affairs or DFA must see to it, it’s done. They must be warned that they cannot just malign us!”

It may be a coincidence that the arrest of Senator Leila De Lima on Illegal Drugs-related cases happen on the day that the People’s Power Revolution is commemorated by the government in a simple and discreet ceremony – just like the Marcos Hero’s burial. Police arrested Senator Leila De Lima after a Muntinlupa Regional Trial Court (RTC) judge issued a warrant. De Lima was arrested at the Senate past 8 a.m, Feb 24 and was brought to Camp Crame for booking procedures like the return of the warrant, mug shots, fingerprinting and more.

Hearing on March 10

De Lima proceeds to the Muntinlupa RTC Branch 204 with escorts where Judge Juanita Guerrero issues a commitment order to detain her at the Philippine National Police Custodial Center. Judge Amelia Fabros of Muntinlupa RTC Branch 205 rules that the hearing for her cases is on March 10. De Lima’s cases are raffled off to Branch 204, 205, and 206. She is back to Camp Crame after the procedure.

Probable Cause

Guerrero orders De Lima’s arrest after she cites a probable cause for the charges against the lady senator. She is facing accusations on her linkage to the illegal drug trade in the New Bilibid Prison while she was Justice secretary from 2010 to 2015. There might be concrete evidence that leads to her arrest but it does not mean yet that she is guilty of the crimes she’s accused of. The senator deserves due process.

Liberal Party Mates Stood by De Lima

De Lima’s arrest is not a victory for the country. It is a continued battle between the Pro-Marcos and Anti-Marcos. The Liberal Party members won’t easily submit to the administration. They will use all their resources to get even. As Filipinos know, the LP is blocking Bongbong Marcos’ return to the executive office. While the president intends to install him at the soonest possible time. Pangilinan, Drilon, Aquino, an Hontiveros support De Lima all the way – as shown in the press conference when she submits herself and shows her readiness to go to prison.

Pro and Anti – Marcos Support among Lawmakers

The Davao Death Squad Probe majority vote in favor of the decision to re-investigate the president’s DDS involvement divides the house. This is despite the fact that the president is a popular one. His strong control in the upper and lower houses diminishes. This is predicted in the past that eventually, some senators and congressmen will turn against him. Senator Richard Gordon challenges those who are anti-administration who pretend to be insiders. The main obvious reason for them to do that is the president’s pro-Marcos idealism because he believes in the competence of the older Marcos that can be continued by the son, Bongbong Marcos.

Koko Pimentel’s NY Resolution: Adapting LP’s Media Trick Against Duterte for Marcos’ Seat?

Senate President Aquilino Pimentel III this 2017 vows not to evade the media anymore. He chose to be quiet in te past with regards to his disagreements with President Duterte’s move. Pimentel opposes Duterte on Marcos’ Heroes Burial and keeps silent about the death penalty and extrajudicial killings. However, he also justifies why he wants Senator Leila de Lima, Duterte’s critic to chair the justice committee. De Lima is later ousted from the position by the senate. This does not erase the fact that many Duterte, Marcos, and Binay supporters suspect that he’s a traitor to the Liberal Party opposition alliance.

Senator JV Ejercito comments that even if there are minor issues with Pimentel’s leadership in the senate, he believes that as of now, he’s senate presidency is stable. There are also not enough threat that could leave in a campaign to oust him. He hopes that the differences are soon be settled.

Oust V.P. Leni Robredo?

Speaker Pantaleon Alvarez denies that the Duterte administration starts to push Vice President Leni Robredo out of her V.P. seat after resigning from her cabinet post. Come to think of it. If. V.P. Robredo is ousted, Bongbong Marcos is not the next in line before the ruling of the electoral protest. If that happens, Koko Pimental takes over the V.P. post. So, if Robredo is ousted, it can’t be the work of the Duterte administration. Can the Liberal Party takes out their own?

Vocal to Media against Duterte?

If the senate president becomes vocal against the actions of the president through the media, that surely results to the division of power in the senate. Duterte won’t dominate anymore in that area. How about the somewhat Liberal views of Pimentel? Does this mean to say that the Liberal Party prefers him to take over the V.P. post than Robredo? Given that her reputation deteriorates at the moment after “Lenileaks,” Pimentel can only be their option – that if he is indeed a traitor to Duterte’s party.

Speculated Plot

Given the nature of the Liberal Party when Mar Roxas is dropped for Grace Poe during elections, they can easily do that to Leni Robredo for Koko Pimentel. Once Pimentel is seated in the V.P. seat, he can then apply his New Year’s resolution to be vocal through the media – and that can include his criticisms to Duterte’s policies, actions and behavior in public to destroy him. The purpose? Be President? Wait, is that supposed to be Bongbong Marcos’ seat?

Senate on Extra Judicial Killings: Police on drugs cleaning out witnesses

It’s been a riddle why President Rodrigo Duterte is so annoyed with Senator Leila de Lima’s divulging that she had witnesses who could testify against police “scalawags” allegedly behind the summary executions of suspected drug dealers to cover up their involvement in the narcotics trade? She is just doing her job in the Legislative Department to neutralize the brutality of the Executive Section on the issue.

As stated in her open letter in Filipino, De Lima urged Mr. Duterte “to follow the inquiry” of the Senate committee on justice and human rights expected to start on Monday detailing her allegations against certain officials of the Philippine National Police who are allegedly doing the accusation. “There is an indication that not all drug suspects are really related to, but that they just coincided with, the campaign against drugs,” she said.

“There are deaths that are being done by corrupt officials and their cohorts to cover up their heinous participation in the drug trade. They are not pushing forward, and are instead diverting, the direction of the fight against drugs and sabotaging the good intentions of the campaign,” she added.

If only the president is listening to common plublic outcry, he would know that de Lima’s theory is right. Why is the president supporting these corrupt police officials?

The president is under public outrage when instead of replying to de Lima’s letter professionally, he accused her of sexual misconduct for allegedly having an affair with her driver – boasting that he has video tapes to prove them. This proves that Duterte is not really concerned of improving public services for the people but he is more inclined to destroying his detractors in a very distasteful manner.

President Rodrigo Duterte and Senator Leila de Lima might not see eye to eye with their own principles but they both know that they are just doing their work and the cross fires between them on certain issues are nothing to do with them personally. Dutertes’ warm and friendly gesture to de Lima during the SONA says it all. Watch the senator’s view on that below:

According to Senator Dick Gordon, if there’s something to investigate about with de Lima as per Calida’s accusations while observing the increase of irregularities that happened at the Bilibid prison involving high profile drug inmates under de Lima’s watch as Department of Justice secretary then, it will likely fall on Senator Gordon’s lap – since it has something to do with graft and corruption that can be channeled through the Senate Blue Ribbon Committee that he will be manning. Again. nothing personal. Just part of the due process system.
