Wilfredo Keng’s Lawyer Retaliates to the Denouncement of Leni Robredo on Maria Ressa’s Arrest

Atty. Joseph Banguis, the lawyer of Wilfredo Keng explains that his client’s case with Maria Ressa is personal and nothing to do with politics. This is after the presumptive Vice President Leni Robredo denounces the arrest and overnight detention of Ressa. The VP who faces an electoral protest filed by Bongbong Marcos said; “We denounce this in the strongest terms.” She implies that the government is behind such action that would force journalists to follow what they want. Banguis reminds the public that Ressa’s slight inconvenience is nothing compared to the misfortunes she caused to his client. z

The Rule of Law is Followed

Rappler CEO Maria Ressa fails to post bail Wednesday night and stays at the NBI. The Palace releases a statement on the issue. Presidential Spokesperson Salvador Panelo said that Maria’s case is not an issue of freedom of expression. This is contrary to Robredo’s statement. She denounces the arrest. There are different reactions to the arrest here and abroad. One thing is certain that the government follows the rule of law. This is why Ressa did not escape her rightful arrest, added Panelo.

The Victim’s Side

Keng’s lawyer is aghast when loud criticisms are everywhere in the mainstream media with regards to the progress of their case since 2012. Rappler’s pronouncements on the alleged involvement of his client with the late Chief Justice Renato Corona whom the Aquino administration removes through an impeachment proceeding causes a big blow to the business of his client. His reputation is also in question when the online media implicates him with their illegal drugs stories that they vehemently deny. The threat on his life is one that exceeds all sufferrings.

A Curse from the Grave

Many believe that Corona’s death due to a heart attack during his prosecution brings a curse to the Liberal Party. Despite their media propaganda using the mainstream press networks under their control. The LP bets for the Senatorial race in 2019 remain unpopular. Worst, the ranking of the existing reelection seekers from their party continue to slide down. One example is Senator Bam Aquino’s rank down that pushes the position of Gov. Imee Marcos up.

Robredo’s Statement

Ressa is a veteran journalist and critic of President Rodrigo Du30. She was arrested by the National Bureau of Investigation (NBI) agents who served her arrest warrant in her office in Pasig City at 5m on Wednesday, Feb 13, 2019. Robredo comes to the aid of the libel case defendant and said: “It’s saddening. We denounce it in the strongest terms”. It seems that the presumptive VP has shown the people that she goes to the extent of siding criminals, offenders, and unlawful people in general just to discredit the President and his allies.

Political Harassment by Leni Robredo?

Leni Robredo also said; “Today, there’s political harassment because of expressing opinions; opposing certain policies becomes an excuse for suppressing the freedom of not just members of the media but also of those who dare to speak out.” This clearly causes division in the country. The supposed second leader of the country only shows that she is not serving the people – but the entities that gave her the title regardless of the people’s will.

The Valentines Day arrest is a shocker to Maria Ressa, Rappler’s CEO who is famous for allegedly spreading lies against the Du30 administration through her own media propaganda that aims to destroy the political enemies of her Liberal Party enablers. She is also instrumental in blocking and minimizing the supporters of Du30, Bongbong Marcos, and Atty. Glenn Chong through Facebook. Her hate towards the non-LP patriots brings her to forge connivance with FB founder, Mark Zuckerberg. On the other hand, Bongbong Marcos continues to inspire Filipinos by disclosing his own love story with wife, Liza Araneta Marcos. This is a hate-mess, love-bless scenario indeed. z

The Blame Game of Maria Ressa

Maria Ressa, the CEO of online news site Rappler critical of the Duterte administration faces her arrest after office hours on Feb. 13, 2018. This is in connection with a cyber libel complaint by a businessman. Their so-called human rights advocates call the incident an act of “persecution.” Despite the fact that the case has nothing to do with the government but rather personal due to her spreading rumors about others without a legal basis just to have an edge in business, she can only blame her detractors for her misfortunes.

No Bail Recommendation

The arrest warrant did not state a bail possibility, according to Ressa’s lawyer, JJ Disini. “People should know that a line was crossed,” Ressa said. This is after she arrived at the National Bureau of Investigation headquarters on Taft Avenue in Manila on the night of her arrest. However, the lawyer should know that it is a bailable offense so, Ressa may have a little inconvenience overnight at the NBI. Not in prison per se.

An Awarded Journalist Can Also be Libelous

“We are going to new lows … We should be worried,” added the Rappler CEO, who was one of those named Time magazine’s “Person of the Year” in 2018 for journalistic work. To address this, Malacañang advises Ressa to concentrate on her defense. “The case against Maria Ressa is not based on any violation of press freedom. She simply commits a crime and the court finds probable cause,” presidential spokesperson Salvador Panelo said.

The Case

The warrant, issued by Manila Regional Trial Court Branch 46 Judge Rainelda Estacio-Montesa, orders Ressa’s arrest in relation to charges under the Cybercrime Prevention Act of 2012. The DOJ recommends it. They take her detention as a dramatic escalation in the legal pressure bearing down on Ressa and Rappler. The company is facing tax evasion charges that can shut it down.

Where’s the Link?

Then Rappler reporter Reynaldo Santos Jr. wrote that a car that services former Chief Justice Renato Corona during his impeachment trial belongs to businessman Wilfredo Keng. Santos alleges that Keng has ties to human trafficking and drug smuggling ring. Five years after the story’s publication, Keng files a complaint against Santos, Ressa and six members of Rappler’s board of directors under the Cybercrime Prevention Act of 2012. The NBI initially dismisses it since the article was published before the law was enacted. But in January 2019, the DOJ revives the charges against Ressa and Santos, as well as Rappler. It is because of the law update that can still cover the said news article in February 2014, and is therefore actionable.

Is Facebook Against Democracy for Pleasing Robredo’s Kind?

The presumptive Vice President Leni Robredo accused of cheating in the 2016 elections by former Senator Bongbong Marcos is happy about the ban of Facebook on a local company behind the pro-President Rodrigo Du30’s posts. “This is huge, like a gift to the people,” Robredo said in her weekly radio program. However, owners of such accounts who are legitimate supporters of the current administration hate Robredo and her kind more. This goes the same to the Marcos supporters. Is Facebook killing democracy in the country? They asked. It is a now a common occurence that these accounts are either taken out or blocked from posting links or articles. z

Hypocrisy Looms

“It’s not for me, but for the whole Philippines that it’s OK to criticize, as long as the basis of criticism is true,” Robredo said. She cites two Facebook pages ran by Twinmark Media Enterprises Inc. – Filipino Channel Online and Trending News Portal – as having “run fake news against opposition figures,” with her as the “number one” target. This is a big puzzle to Filipinos because of this questionable VP’s supporters are also doing the same thing. In fact, she is popular as the ultimate source of Fake News against the Du30 administration. She is also critical about the Marcoses using unfounded lies.

Selective Democracy

Not enough, she said that Facebook should continue such actions, claiming that thousands of fake troll accounts still exist including the ones from her group. She often blasts the government as an entity that does not allow words of decent. That every time she’s ignored, it is already her common expression that democracy dies. Is democracy dead then again?

Not a Big Deal for the Administration

Malacañang earlier shrugs off Facebook’s decision to remove some pro-Duterte pages for violating its policies. There are other platforms that supporters can use to show their appreciation for the administration. Presidential Spokesperson and Chief Presidential Legal Counsel Salvador Panelo made the statement before and its stand so far does not change.

A Democratic Government

The reaction of President Du30’s speaker is very democratic. “Facebook must have its own rules and regulations. If they are implementing them, that is their own rule,” Panelo said.

Social Media Dominance

It is known that Maria Ressa meets with Facebook’s Mark Zuckerberg to complain about the subject. As a result, the opposition gets the advantage from the platform from then on. This prompted the affected ones to innovate systems where they can express their sentiments democracy-wise. As talented as Filipinos can be, it’s only a matter of time that Facebook’s dominance in the Philippines becomes vulnerable.

Atty. Glenn Chong, Katipunan ng Demokratikong Pilipino (KDP) Candidate for Senator this 2019 election lashes back to Rappler’s Maria Ressa’s previous headline that Bongbong Marcos disowns him. He said that he is lucky to be disowned because it made him credible when it comes to his clean election advocacy. Whereas, the presumptive VP Leni Robredo’s defender Maria Ressa has to bail out after her arrest due to tax evasion cases.

Chong’s Challenge

Atty. Chong said that the camp of Leni Robredo tries to mislead the Supreme Court when she files another motion for consideration on her complaint to him that he is affiliated with Bongbong Marcos.  She is lying again when she said that the latter did not answer her accusation. This is on how he got the Ragay data that show election anomalies against BBM’s opponent. In fact, it is in Paragraphs 33 to 42. It is clear in Paragraphs 41 at 42, where all her questions are answered. The only problem according to Chong is – they keep on lying to the public to suit their own narrative. He challenges Robredo that if he’s wrong, to just charge him in court.


Warrant of Arrest for Ressa

Maria Ressa evades arrest by posting bail at a Pasig City Regional Trial Court. Her charge is tax evasion. Judge Danilo Buemio of Pasig RTC Branch 265 issues a warrant for Ressa’s arrest. This is for violation of Section 255 of the National Internal Revenue Code of 1997. The bail is set at P60,000.


Out on Bail

Tagum City Executive Judge Arlene Palabrica ordered the release after their lawyers posted a total bail of P1,452,600. Davao del Norte police “initially wanted to defy the order.” The police argued that the P80,000 bail was for the child abuse charges only. It does not include the kidnapping and human trafficking charges. They are still under investigation.



A Rebel’s Mentality

Ressa maintains that the cases had no basis. She said that her company pays the right taxes. Unless the government reclassifies it into a stock brokerage agency given that it has foreign investors. Are the cases the response to its anti-government coverage? “I think it is a way of sending a signal that we have to be careful. That’s part of what they want to do,” she added.

Digital Karma

Chong mocks Ressa for bringing her own mugshots. He thought that she’s brave enough to face the consequences of her actions. Being the aid of the country’s greatest liar, she can end up a lot worse than that. Her group is responsible for creating destructive media propaganda not just against the President but the country itself. They never failed to give Robredo a massive coverage while she reports many lies not just locally but internationally.

Social media like Facebook are democracy in their purest form. Whatever is popular wins over there. This is contrary to the report of Rappler CEO, Maria Ressa. These platforms are not newsmakers but mediums for public opinions. Popular topics go viral because of major interests by the people. Mainstream media simply have a different system. If VP Leni Robredo’s Camp cannot topple Bongbong Marcos online despite their many trolls and fake news, he is, therefore, the real winner for the post. The recount on his electoral protest against Robredo is in February 2018.

Like and Share Functionality

Facebook has no liability over the spread of “fake news” because it does not produce them. Users spread them by clicking on the “Like” and “Share” buttons of the platform. This proves to show that such sentiments are from real people. One tends to share a favorable news from a friend.




Liberals’ Undermining Democracy

Liberals like Ressa and their media counterparts locally and in the United States are famous for blaming others for their own doings. VP Leni Robredo always refers to the alleged trolls and fake news of Bongbong Marcos whenever she suffers low ratings. However, she and Ressa never question Silent No More that favors them. They attack the majority who are against them. This is not a democracy.




Du30’s Endorsement Helped Bongbong Marcos

President Rodrigo Du30 did not win because of social media propaganda. His approval rating is still high after almost two years in power. That is not achievable if his popularity is based on lies. In fact, his endorsement of Bongbong Marcos as his successor makes the latter as the preferred VP. He is likely to win the recount for his electoral protest against Robredo if Facebook data is consistent with his number of votes.
