Is Senator Koko Pimentel Falling Short of his Promise to Present Smartmatic to the Public?

senator

By: Elena Grace Flores

During the last Senate committee meeting on September 13, 2018, Senator Koko Pimentel pledged that Smartmatic people must divulge their knowledge on the alleged 2016 election fraud. Two months had passed by and this promise is still hanging. However, he prioritizes the filing of his questionable certificate of candidacy and his recent marriage. Does this mean that there’s no more public hearing on this issue?

Two Kinds of Senate Hearings

There are two types of hearings in the Senate. First is the public hearing where it is open to the media and the public. Then, the executive sessions where the media and the public are not allowed. Only members of the Senate and the Congress can attend such meeting. Atty. Glenn Chong’s team members are worried that Senator Pimentel’s committee would opt for the executive session. Given that this could save Smartmatic from further embarrassments.

Pre-judged Case?

Smartmatic in partnership with Comelec is obviously very powerful. Only a public hearing can justify a clean mid-term election. However, it is notable that Pimentel’s committee is very quiet nowadays. It could be that an executive session is now cooking if the running Senator is in connivance with the riding in tandem, as Atty. Chong puts it.

Regaining the Public’s Trust

As long as the Smartmatic witnesses cannot be presented in a public hearing, the people will surely doubt the integrity of the elections in 2019. It would look like the committee is protecting the Comelec and Smartmatic fraud syndicates. The Senate would surely lose its credibility as a worst-case scenario.

Confusion on the Law

The Constitution provides that the term of office of a senator is six years and that no senator can run for more than two consecutive terms. “In the case of Pimentel, he lost in the May 2007 election for senator but eventually won his election protest against Senator (Juan Miguel) Zubiri in August 2011 and served merely the remaining two years unexpired term of Zubiri from August 2011 to June 2013”. Pimentel’s election lawyers cited the 2017 case of Albania vs. Comelec, where the High Court reiterated its previous similar doctrines in other election cases that the period of time that an elective official served after winning his election protest “did not constitute a complete and full service of his term as he did not hold the office for the full term of three years to which he was supposedly entitled to.” Other lawyers also disagree with this analysis.

Newly-Wed Blues

Pimentel, 54, married partner Kathryna Yu, 36, in a civil wedding ceremony last October 18, at the Coconut Palace. Supreme Court Associate Justice Antonio Carpio officiated the wedding, which was attended by big names in politics and showbiz. President Rodrigo Du30 and close aide Bong Go who also runs for Senator led the principal sponsors. Despite the newly-wed blues, Atty. Chong still insists on Pimentel’s response as to when the next public hearing would be on the election fraud issue?

Glenn Chong Asks Comelec where’s the 10 Missing Voting Machines are for Election 2019?

election

By: Elena Grace Flores

“Massive testing” will start today by vote counting machines and other election systems for their use in 2019. This will definitely be used as a “massive propaganda” of the syndicate, said Atty. Glenn Chong. He also joins the PDK, DDS, and BBM group leaders to talk about the VP electoral fraud which is a hot topic in the country today.

10 Missing Voting Machines

The Comelec admits that the 10 voting machines are indeed missing. However, they cannot explain to the public why they have not been returned to the poll agency yet after the 2016 elections. This is until now after a long 2 years and 5 months has passed. Their officials are not even taking responsibility for their disappearance.  The Senate hearing on September 13, 2018, got the record for the admission.

Cheating in Election 2019 is More Likely

Due to Comelec’s incompetence in safeguarding the voting machines, the people will always think that the next election in 2019 cannot be a clean and honest one because these machines can actually generate votes for the manipulators, added Chong.

Independent Operation Theory

INDEPENDENT OPERATION: These machines have been stolen by the politicians who are the conniving candidates with the syndicate as per the case in Biliran in 2010. They can be used in to conduct their own fraudulent activities to match with the maneuvers of the Comelec and Smartmatic personnel. There are various cheating procedures that can be done technically using those devices.

Syndicated Operation Scenario

SYNDICATED OPERATION: These machines will be used as cloned VCMs. This can be a widespread operation by the Comelec syndicates and Smartmatic itself. If the Comelec and Smartmatic are not guilty of this scenario, they must have been found already. Their whereabouts should not be a mystery. The culprits must also suffer the consequence. To the contrary, the Comelec just refuses to answer.

Tools for Cheating

Chong explains to the PDK, DDS, and BBM group leaders its significance. The missing VCMs are enough to let any Senator win. Take the case of the 459 result transmissions a day before the election in 2016. That can happen again in 2019. They would surely make use of the plan by just setting the issue aside. However, the PDK, DDS, and BBM groups continue to make noises.

Atty. Trixie and Glenn Chong’s Plan B to Prevent 2019 Smart Election Cheating

election

By: Elena Grace Flores

Atty. Glenn Chong shared this petition form that Atty. Trixie Cruz-Angles started. They urge people to sign this form if they agree with their PLAN B. Its goal is to prevent the imminent widespread of smart election cheating: Protect the Philippine election from smart cheating  Please sign another petition and share this campaign instead of the payment option. This was launched after the Commission on Elections has opted to continue the use of Smartmatic for the 2019 elections. It happened despite the 2016 election revelations made by Atty. Chong and examination results in the Marcos vs. Robredo vice presidential recount that indicate possible massive electronic cheating.

Signature Campaign

As of this writing, 41,918 have signed. At least 50,000 signatures are needed to compel Comelec and Smartmatic to follow the people’s wishes. A simple solution can check this cheating procedure and return the people’s trust in the electoral exercise by counting the voter’s receipts.

PROPOSAL UNDER PLAN B:
1. A voter enters the precinct, check the BEI if registered, and get a ballot.

2. Vote for the favored candidates

3. Enter the ballot into the machine.

4. Retrieve the receipt of the casted ballot and while still near the ballot box, check whether the intended votes are correct or not as per the record on the receipt. (Confidential)

The Importance of the Voting Receipt

They propose that at the end of the voting day, the Board of Election Inspectors convene with the watchers of the national candidates or their parties and count the votes contained in the voters’ receipts. These receipts are kept in a separate box that the BEI can open and count. The counting may be limited to the candidates for senators, congressmen, governors, mayors, and party lists.

5. At the yellow ballot box, the voter should check:

a. If the machine did not make a mistake as per the receipt. Drop the receipt into the box and go out of the precinct.

b. If something is wrong in the receipt, let the poll watchers know while they are still there to record the error. Go to the BEI to record the complaints on the Minutes of Voting where the receipt is filed.

6. Poll watchers and accredited citizens’ volunteers will make sure all receipts are dropped into the yellow ballot box.

7. After the polls, while submitting the results and printing 30 copies of the results for up to 2 hours, one of the BEI officers will be responsible for the Manual Audit Committee (MAC).

Manual Audit

After counting, these can be compared with the tally posted at the door as well as those transmitted to the city. This simple procedure will require no extra cost except for the small amount of time allocated for this activity.

8. Poll watchers and the accredited citizens’ volunteers will become MAC members to perform a manual count of votes on receipt. Since the data is printed on the receipt and it is clear, the process can be very fast after the manual audit. (GENERAL DEVELOPMENT)

9. The vital positions are for the Senators, Party Lists, Congress Representatives, Governors and Mayors only.

10. The public may observe manual audits outside the precincts.

11. After manually counting the votes on the receipt, the result is compared to the number of votes made by the machine.

Minutes of voting

b. If the difference in the manual count from the automated count is significant, it is already a sufficient reason to suspend the proclamation of the winners. Ballot counts must be done in a public place. The final ballot manual count results will prevail.

12. Uncovered voter complaints recorded by poll watchers and BEI in Minutes of Voting, if any; and the general variation of the manual count on the automated count, if any, should be posted in a centralized public reporting facility in Manila with the app to study it and take appropriate action. COMELEC and accredited citizens’ volunteers can implement their own reporting facilities.

A separate written petition will be sent to the COMELEC to formalize this petition. If the manual count is incompatible with the automated count, this is enough reason for a candidate to protest.

Only the Cheaters are Against this Election Plan B

There is no doubt that there are many methods of automated system fraud. But the voters or any group cannot effectively control all these methods with one and a half steps. If there is a validation of the correct reading and the correct counting of votes done, all the different forms of automated system fraud will be effectively recognized and therefore prevented using a the double-verification process of the receipt of the votes. This is an effective warning to deceivers to allow a clean and reliable election to happen.

Why does Robredo Need to Highlight her Insecurity with Imee Marcos to Endorse Roxas for Election 2019?

election 2019

By: Elena Grace Flores

Mar Roxas ends his semi-retirement in politics as he files the certificate of candidacy in Election 2019 for Senator. Since Smartmatic still operates the poll, there are still yellows who can win through the fraudulent machines. This is some kind of payment for the debt of Smartmatic to Noynoy Aquino when he allowed it to administer the 2016 elections despite its disqualification. Meanwhile, Leni Robredo stresses the reason why Roxas is running. It’s because “there is another Marcos again” who will run in the Senate, she said. She is referring to Gov. Imee Marcos. If Marcos was actually the reason for Roxas’ candidacy, why didn’t he wait for her to file her candidacy first before his? So clearly, the governor is not his reason for his decision. Roxas is really excited to run because he knows he can win with Smartmatic’s manipulation, according to Atty. Glenn Chong.

[VIDEO]: Mar Roxas at Imee Marcos, naghain na ng COC sa Comelec

Senator to be Imee Marcos’ Solutions

Imee Marcos focuses on the chant “Imee, solution,” of her supporters and zones out the chants of “Never again to Martial Law” by supporters of the opposition senatorial bet Chel Diokno. On Tuesday, the 16th of October, 2018 she filed for her certificate of candidacy at the Commission on Elections.

Family Support

She is accompanied by her family. Her mother was there, former First Lady Imelda Marcos, who is also seeking to fill in the Ilocos Norte governor slot in the election 2019. Her brother Bongbong was also there, who is currently contesting the results of the 2016 elections for vice president.

The Bet of the Millennials

Imee Marcos is appealing to the Millenials. She once headed the KB, the forerunner of the Sangguniang Kabataan, during the Martial Law period. In an interview, she says that the times are different now. Furthermore, the millennials are now willing to hear about their side of the story.

Roxas Filed his COC for Election 2019 First

As another senatorial bet of the LP, Mar Roxas, the former interior secretary, arrived to file for his Certificate of Candidacy prior to Imee. The Marcos supporters still shouted their support for Marcos. Roxas responds, he says in a video that he had taken an examination of conscience for the past weeks. He ascertains that despite his imperfections as well as shortcomings, he still believes that he has given his best to serve the country as well as its people.

Democracy in a Divided Nation

The supporters of both sides taunted each other outside of the Comelec. Marcos, under the Nacionalista Party, and a Du30 ally, and Diokno, running under the opposing Liberal party, did not talk to each other during the filing of their COCs. Even Mar Roxas comments upon arriving at the Comelec that democracy is very much alive. This is contrary to the lie of Robredo that it is now dead. The presumptive VP is known for her lies and fake news just to discredit the current administration for her party’s own advantage. It is clear that she has to cover her own insecurity with Bongbong Marcos using his sister and her LP co-member’s  senatorial rivalry.

Can Former Senator Bongbong Marcos Continue his VP Duties Despite Criticisms?

senator

By: Elena Grace Flores

The ongoing election protest of former Senator Bongbong Marcos against the presumptive VP, Leni Robredo is instructive over the results of the vice presidential contest. The tell-tale signs of a concerted effort to ensure that the wishes of then-President Benigno Simeon Aquino III to block Marcos’ return to the executive office are obvious. His party supporters safely carried out their quest during elections. Smartmatic obviously ensures the victory of the pro-Aquino slate. However, despite the mainstream media blackout, the son of the late President Ferdinand Marcos remains to thrive because of his clan’s good governance.

[VIDEO]: I always believed in the importance of the LGUs, having spent most of my public service career in local government. To all the barangays in Quezon City, congratulations on a job well done!

Ex-Pnoy’s Wrath

The most sophisticated cheating strategy happens in the highest levels of the Comelec. This is under the baton no less of the infamous ex-Comelec Chair Andy Bautista. He organizes what turns out to be the most corrupt electoral system and practice in the country’s history.  That starts from the leak of the list which the National Privacy Commission exposed. It turns out that the same was the handiwork of a group of Comelec employees working in tandem with LP manipulators.

Follow-up on Senator Tito Sotto

Calls for Senate President Tito Sotto and Senator Dick Gordon occupy social media platforms. People are making follow-ups on the verdict of the hearings conducted. They owe it to the public to make the 2016 elections mishaps as the basis to safeguard a clean, honest and credible elections in 2019. The joint legislative committee on the automated electoral system has gathered enough information. They can easily craft a good model for the next elections if they want to.

Tweaking Excuses

The tweaking of the “N” in the middle of the national canvass by Venezuela Marlon Garcia already casts doubts on the 2016 elections. Neither Comelec nor Smartmatic cannot come up with credible excuses. The overwhelming public view that it caused Marcos’ over-a-million lead to vanish dramatically remains. Thus, the ongoing protest at the Presidential Electoral Tribunal is very much alive. In fact, it leans towards Marcos’ victory. It is even supported by the IT experts in the country.

Never Again to Smartmatic

The people should never again let Smartmatic and its co-conspirators to make a mockery of our electoral process. Foreigners must not decide the fate of our democracy. They are the reason for all kinds of problems and questionable results using their automated electoral system. The oligarchs benefit greatly from the results they generate.

Where is Democracy?

Smartmatic’s monopoly over Philippine elections was perpetuated by PNoy-appointed officials. Acting Comelec chairman Christian Robert Lim awarded the supply contract for the vote counting machines (VCMs) to be used in the May 2019 midterm elections to Smartmatic. This was three weeks before his scheduled retirement on February 2, 2018. Also, it was without the benefit of any bidding or public notice. Now, it would be too expensive for the government to eliminate that. Therefore, Marcos’ critics have no right to stop Marcos from inspiring the LGUs to promote good governance. The pro-Marcos community is larger than the black media propaganda his detractors launched against him because they are the real voters.
