Supreme Court Justice Carpio: China War Not an Option, Joint Exploration Okay but Change their Mindset

Bongbong Marcos earlier said that the 2016 legal victory of the Philippines against China before a United Nations-backed arbitral tribunal. This invalidates Beijing’s expansive claim to the South China Sea creates tension with the powerful neighbor. Supreme Court Senior Associate Justice Antonio Carpio then clarifies that the joint exploration with China does not violate the constitution. This is because the Philippines is still in full control with the operation. What’s unconstitutional is the China war threat. Carpio suggests trying to change the mindset of the Chinese people that they do not own the South China Sea through international influence and social media. z

Change the Mindset

Carpio reiterates his call for a more vigorous campaign to change the mindset of the Chinese that the West Philippine Sea does not belong to China. He also said that there are bills pending in Congress that push for the declaration of portions of the West Philippine Sea as a marine sanctuary.

Call for Unity to Enforce Ruling

The Social Weather Stations releases results a month ago that shows 84 percent of Filipinos want the Du30 administration to do more against China’s intrusion in the West Philippine Sea. Carpio said that 84 percent can increase at the end of the year. “That is good because it is only when we are united can we get the ruling enforced,” he said

No Legal Basis for China’s Claim

He said the Philippine government should continue to assert its rights over the West Philippine Sea. It should do something to fortify the ruling given by the Permanent Court of Arbitration in The Hague in 2016 every year. The ruling states that China has no legal basis for its nine-dash line territorial claim.

Educating the Chinese People

He also said that Filipinos should take time understanding the issues. That way, they could better explain the country’s position to other nationalities. They have the mission to convince other countries of the Philippines’ position. This is in the hope that together they could convince the Chinese people that the West Philippine Sea does not belong to them.

Downside of the Supreme Court Justice’s Plea

The Supreme Court Justice knows that China will never accept the ruling. Not unless the Chinese people realize that their historical narrative 2000 years ago is false. Since grade school to college, they have been taught that they own the South China Sea. They really believe it because they were not taught other things,” he said. However, it seems vague how the Filipinos with the help of other nations can change the mindset of over 1.3 billion people. This can actually cause more tensions between the two countries.

Substitution Strategy

The fight for the post of Ilocos Norte governor goes down between a Rodolfo Fariñas and Matthew Marcos Manotoc, Imelda Marcos’ grandson. Farinas, who is Ilocos Norte 1st District representative runs for governor in his home province as a substitute for Jesus Arimboyutan under the PDP-Laban political party. The 67-year-old Fariñas faces Manotoc, Marcos’ grandson and son of incumbent Ilocos Norte Governor and senatorial candidate Imee Marcos.

Due Course for the Iron Butterfly

The Sandiganbayan 5th Division starts proceedings for the transmittal of records of graft cases of Ilocos Norte Rep. Imelda Marcos. The anti-graft court said that they now prepare copies of the documents. The original records would be sent to the high court. The court also discloses that the notice of appeal that Marcos filed is “given due course.”

The Marcos Matriarch’s Request

In her notice of appeal, Marcos requests for the record transmission to the Supreme Court where she plans to challenge the Sandiganbayan decision. The Sandiganbayan convicts Marcos of 7 counts of graft last November 9. Her sentence of 6 to 11 years in jail for each count is pending as she is about to make an appeal to the high court.

Free on Bail

Rep. Marcos posts Php 300,000 bail as she appeals her conviction. Nonetheless, most mainstream media under the control of the opposition and their allies are quick enough to circulate massive negativity to malign her. Manotoc’s takeover neutralizes the black media propaganda. The move even made him look even much better.

Manotoc is Hot

It turns out that Manotoc is not only appealing to the millennials but also to all ages. Fariñas can’t stand a chance after his rudeness to the Ilocos 6. Now, it would be a big challenge for the Marcoses’ detractors to launch a character assassination stunt against the younger bet because it would be very obvious.

The New Supreme Court Chief Justice Only Begs for One Thing Amidst the VP Electoral Protest

Supreme Court Chief Justice Lucas Bersamin begs for independence in the judiciary. He knows that Bongbong Marcos’ electoral protest against the presumptive Vice President, Leni Robredo divides the country. He, however, promises to make reforms during his 11-month tenure in the SC. Among his priorities are to make procedural law court proceedings to be less tedious, less intimidating, more economical and speedier. That would certainly help resolve the VP conflict.

Objectives of the New Supreme Court CJ

Chief Justice Bersamin said in his speech during the culmination event of the “Judicial Strengthening to Improve Court Effectiveness (JUSTICE) Project; “I shall make it my objective to lead the Supreme Court and the rest of the judiciary in respecting and promoting the rights of our people, thus I will prioritize reform of our procedural law to make court proceedings less tedious, less intimidating, more economical and speedier.”


Independence in the Judiciary

Bersamin emphasizes that the judiciary must remain independent. “We are part of a sovereign nation, the judiciary, but our role is to be an independent judiciary. We cannot always go to the other 2 branches of government to ask for assistance,” he said. He is grateful to several stakeholders for helping the Philippine judicial system. This is by funding its projects.


Replacing Another Short-Term CJ

Bersamin takes over his Supreme Court post recently. He replaces Teresita Leonardo-De Castro who retired from government service in Oct after just barely serving as Chief justice for 3 months. Short as it may seem, these presidential appointees have it in their records that their decisions are in line with the President’s goal of serving the people.



More Requests

Earlier, the new CJ had something to ask: “Welcome me, I ask you to welcome me, to love me, to support me,” 25th Chief Justice Lucas Bersamin told Supreme Court officials and employees during his first flag ceremony as a head of the judiciary.

Accidental CJ with a Purpose

Bersamin added: “I am an accidental chief justice but that is not a statement of apology. I do not apologize to anyone for having been appointed because that is the wisdom of the President, who is the appointing power. Please accept me.” Despite his humility, it is obvious that the opposition is always insecure about Bersamin’s voting for the ouster of Sereno and the late President Ferdinand Marcos’ burial at the Heroes’ Cemetery. They can only guess how he would vote for the VP case ruling.

Bersamin was accompanied by his family at the Heroes Hall. Bongbong Marcos’ supporters are hopeful that with the current development, their votes will finally be counted

The President Chooses Bersamin Over Carpio

Du30 appointed Bersamin to replace former chief justice Teresita Leonardo-De Castro, who retired on October 8. Aside from Bersamin, Associate Justice Ramon Paul Hernando and Associate Justice Rosmari Carandang also took their oaths of office on Tuesday.


Trusting the Wisdom of PDu30

CJ Bersamin said that he trusts the wisdom of a President who is the appointing power. Please accept me, he begs during a flag ceremony at the SC grounds. Bersamin tells employees of the Supreme Court that those who were not there at that time, have reasons why they were absent. He accepts the fact that not all staff agree with the President’s decision.


Not Apologizing for the Appointment

“I know that you have expected maybe another individual to be appointed to this office,” said Chief Justice Lucas Bersamin, “I am not apologizing for my self, I am not apologizing for the President. I am here because I was appointed.”



Seniority is Not the Case

Bersamin was only the 3rd most senior justice out of the 4 applicants. The time-honored tradition of seniority has never been more pronounced at the High Court. Malacañang explained that Bersamin was considered the most senior because he had served in the judiciary the longest. He has served as a judge since 1986. However, he is not the most senior in the Supreme Court per se. 

Bongbong Marcos’ Chance

Bongbong Marcos’ supporters bank on the President’s hand in finally fast-tracking the electoral protest of Marcos against the presumptive VP, Leni Robredo. PDu30 has no jurisdiction over the recount proceedings. The only thing he could do is to appoint a fair Supreme Court justice. A CJ that is in line with the ideals of the government. Bersamin’s record shows that he is for the welfare of the country and its people.

Atty. Glenn Chong, Katipunan ng Demokratikong Pilipino (KDP) Candidate for Senator this 2019 election lashes back to Rappler’s Maria Ressa’s previous headline that Bongbong Marcos disowns him. He said that he is lucky to be disowned because it made him credible when it comes to his clean election advocacy. Whereas, the presumptive VP Leni Robredo’s defender Maria Ressa has to bail out after her arrest due to tax evasion cases.

Chong’s Challenge

Atty. Chong said that the camp of Leni Robredo tries to mislead the Supreme Court when she files another motion for consideration on her complaint to him that he is affiliated with Bongbong Marcos.  She is lying again when she said that the latter did not answer her accusation. This is on how he got the Ragay data that show election anomalies against BBM’s opponent. In fact, it is in Paragraphs 33 to 42. It is clear in Paragraphs 41 at 42, where all her questions are answered. The only problem according to Chong is – they keep on lying to the public to suit their own narrative. He challenges Robredo that if he’s wrong, to just charge him in court.


Warrant of Arrest for Ressa

Maria Ressa evades arrest by posting bail at a Pasig City Regional Trial Court. Her charge is tax evasion. Judge Danilo Buemio of Pasig RTC Branch 265 issues a warrant for Ressa’s arrest. This is for violation of Section 255 of the National Internal Revenue Code of 1997. The bail is set at P60,000.


Out on Bail

Tagum City Executive Judge Arlene Palabrica ordered the release after their lawyers posted a total bail of P1,452,600. Davao del Norte police “initially wanted to defy the order.” The police argued that the P80,000 bail was for the child abuse charges only. It does not include the kidnapping and human trafficking charges. They are still under investigation.



A Rebel’s Mentality

Ressa maintains that the cases had no basis. She said that her company pays the right taxes. Unless the government reclassifies it into a stock brokerage agency given that it has foreign investors. Are the cases the response to its anti-government coverage? “I think it is a way of sending a signal that we have to be careful. That’s part of what they want to do,” she added.

Digital Karma

Chong mocks Ressa for bringing her own mugshots. He thought that she’s brave enough to face the consequences of her actions. Being the aid of the country’s greatest liar, she can end up a lot worse than that. Her group is responsible for creating destructive media propaganda not just against the President but the country itself. They never failed to give Robredo a massive coverage while she reports many lies not just locally but internationally.
