Can AJ Lucas Bersamin’s Appointment as Supreme Court Chief Justice Prevent Scalawags?

With the retirement of Chief Justice Teresita Leonardo de-Castro, Associate Justice Lucas Bersamin then accepted his automatic nomination for the post of Chief Justice of the Supreme Court. Shortly, before this, President Du30 appointed Associate Justice Paul Hernando from the Court of Appeals to the Supreme Court. So far,  the President has appointed six associate justices in the SC. They are Martires, Noel Tijam, Andres Reyes Jr., Alexader Gesmundo, Jose Reyes, and now Hernando. Bersamin previously voted against the ousted Chief Justice Marcia Lourdes Sereno.

Sufficient Time

With the mandatory retirement age at 70, Bersamin said he still has sufficient time to make the Supreme Court’s image better despite retiring next year. He underwent a public interview before members of the Judicial and Bar Council for the application process of the chief justice post.

More Powers to the JBC

Furthermore, Bersamin says that he will grant more powers to the JBC should he be appointed as the next Chief Justice. This is to avoid making mistakes in appointing aspirants to judicial positions. He believes that the JBC needs more muscle to look into the qualifications of the applicants. Incidentally, he was one of the 8 magistrates who voted to nullify Chief Justice Sereno’s appointment. This is based on her alleged lack of qualification.


New Supreme Court Associate Justice

With his appointment to the Supreme Court by President Du30, Hernando takes his oath of office soon after. He appears before Associate Justice Diosdado Peralta, who incidentally is his wedding godfather.  In the CA, Hernando maintains an impressive record. He has zero backlogs, 417 disposed of cases in 2013 and 370 in 2012. With him being 52 at the moment, he still has 18 years to serve before the mandatory retirement age.

Bersamin to Prevent Sereno-Like Appointment

“There is no insurance to these kinds of mistakes. I do not ascribe that to the JBC. I rather ascribe that to the shortcomings of the pre-vetting process,” quoting Bersamin. He believes that we should improve the selection processes of the judiciary. Because there are still undeserving people who manage to get appointed. However, he is yet to elaborate what additional powers he intends to give to the JBC.



Inadequate Publication Allows Scalawags in the Country to Rule

To quote Bersamin again, “The solicitation of reactions from the public about the candidates might be lukewarm because the public may not generally know, through inadequate publication, that this and that fellow who is applying is a scalawag to our community.” As another point of interest, Bersamin also wants to look into corruption allegations into the members of the Judiciary, should he be appointed.


Seniority at the SC

Under the rules of the JBC, the five most senior justices of the SC are automatically nominated for the post of Chief Justice should it be vacant. The most senior SC Justices are Bersamin, Peralta, Antonio Carpio who is the acting Chief Justice, Mariano del Castillo and Estela Perlas Bernabe. Chief Justice De Castro’s term may well be the shortest term in the high court’s history. However, this signals the return of the seniority culture in the SC that former President Benigno Aquino III disregarded by appointing Sereno. Aquino vowed to block Bongbong Marcos from the executive office in any way that he can.

Bongbong Marcos Believes that Supreme Court CJ De Castro can Set Directions on his VP Protest in 5 Weeks

Vice Presidential protestant against the presumptive Vice President Leni Robredo, Bongbong Marcos gives his actual updates on the case during the interview with Erwin Tulfo. Marcos said that the Supreme Court that sits as the PET must make a decision on what to do with those questionable ballots. He also has high hopes that the new Chief Justice Teresita De Castro can set directions on his protest during the short 5 weeks of her term before her retirement.

The Supreme Court to Decide on the Questionable Ballots

The Supreme Court is beginning a manual recount of the votes. However, Bongbong Marcos calls the PET’s attention to the questionable ballots. Some have been doused only recently, while several audit logs are missing.




Wet Ballots

Starting the recount from Bato Camarines Sur, there were already problems. 4 out of 42 voting precincts had the ballots wet. Consequently, the ballots are illegible. Furthermore, 38 precincts in Bato have the audit logs missing.



Robredo’s Demands

The camp of VP Robredo wants the PET to have the ballots where the ovals are shaded less than 50% but higher than 25% to be segregated. Robredo’s lawyers are also asking the PET to immediately resolve the April 18 resolution. They want the PET to reconsider the decision of a 50% threshold for vote validity.




Macalintal Dares Marcos on the Use of Ballot Images

Macalintal is now challenging Marcos. The picture images of the ballots should be used to determine the real results of the previous election. With the Comelec’s affirmation that the 25% threshold was used, Marcos’ claim that the threshold wasn’t used in the 2016 elections is now exposed as false, said the veteran lawyer. He also comments that Marcos is afraid to know the truth.



Atty. Rodriguez Blasts the Comelec’s Connivance with Robredo

Marcos’ lawyer, Vic Rodriguez is now calling the Comelec as a co-conspirator of VP Robredo, in response to Macalintal. Furthermore, Atty. Glenn Chong reveals the information that at least one SD card had been tampered with upon checking. Chong continues that with each card containing 500 votes, by switching machines, the 5000 extra SD cards could have been used to produce 2 million votes in favor of the victor during the 2016 VP race.

Moving Forward with Bongbong Marcos to the Nation’s Progress for the Mid-term Election

The Marcos loyalists movement in Dapitan like any chapters nationwide aims to help local officials for the progress of the nation. All these initiatives are moving forward together with Inday’s Sara’s Hugpong political party, This is vital for the mid-term election in 2019 for a better and safer Philippines with more opportunities for an improved lifestyle, said Bongbong Marcos. Meanwhile, the PET denies Marcos’ motion asking for Supreme Court Associate Justice Alfredo Benjamin Caguioa’s inhibition from the case for utter lack of merit. It justifies by saying that being a Pnoy appointee does not make him bias. This is actually fair enough for as long as any future rulings in favor of Marcos won’t be blamed to the new SC Chief Justice Teresita de Castro.

Growing Family

Bongbong Marcos was filled with joy when he was invited to an induction ceremony of the Marcos Loyalist Movement. Moreover, it is the first batch of officers who are being inducted. To quote Marcos, “I was honored to join the Marcos Loyalist Movement during the induction of their inaugural batch of officers in Dapitan City, Zamboanga Del Norte,”. He also adds, “Knowing there’s a family I can count on inspires me to continue my fight for truth and genuine public service. Thank you very much for the trust!”.




Du30 – Marcos Alliance for the Mid-term Election

For the 2019 Mid-term elections, Sara Duterte is endorsing Sen, Cynthia Villar, Gov. Imee Marcos and Rep. Zajid Mangudadatu. They are among those who are also endorsed by her regional party, Hugpong ng Pagbabago. Imee Marcos believes that the Hugpong ng Pagbabago will be the voice of Mindanao. On Monday, she had formally formed an alliance with the HnP. She compares the HnP to the Solid North, the regional alliance of the Marcos Family. Like the Solid North, HnP’s approach is very local, unlike that of a traditional party.

 


The PET’s Neutrality

In a 14-page resolution dated Aug. 28, the SC, sitting as the Presidential Electoral Tribunal (PET), denied Marcos’ motion asking for Caguioa’s inhibition from the case for utter lack of merit. “The foregoing shows that Justice Caguioa’s conduct of the matters in this protest has been nothing but impartial. Further, it bears reiterating that all decisions of the Tribunal have been arrived at through majority vote of all the members of the Court sitting en banc. As provided under Rule 66 of the 2010 PET Rule,” the PET said.




En Banc Process of the Election Tribunal

Marcos earlier accused Caguioa of “evident bias and manifest partiality” in favor of Robredo. In his extremely urgent motion to inhibit, Marcos accused Caguioa of bias towards the “yellow brigade” as he took note that the magistrate has close ties with former President Benigno Aquino III.  The PET, however, rejected the motion and sternly warned” Marcos and his lawyers that “any unfounded and inappropriate accusation made in the future will be dealt with more severely.” It said that Caguioa “has been nothing but impartial” in his conduct of matters involved in Marcos’ protest against Robredo, and explained that all decisions have been reached through a majority vote of the Court en banc.




Constitutional Transition towards the New Golden Age

The current action of the PET is part of the constitutional process. This is necessary to assure the public that the decisions they make are from the en banc. Not just from a single magistrate. Since the alliance between President Du30 and Bongbong Marcos is already proven to be formidable, the Filipinos are certain that a favorable ruling on Marcos’ protest against Robredo can happen soon. It only takes time because of the constitutional processes necessary. With the emerging alliance between Imee Marcos and Sara Du30-Carpio for the upcoming election, there’s no stopping to moving forward towards the new golden age phenomenon. This growing alliance is the cause of optimism to some, and bouts of sleepless nights to others.

Bongbong Marcos is the Next Golden Age President when Election Protest is Favored

The former senator Bongbong Marcos states that he does not take President Du30’s succession statement “so seriously.” Although, he points out that the chief executive is fully aware that Filipinos need his help. “I know he is still needed by this country,” he said. Marcos stresses that consumer interest will also have to be on the front seat of his administration. That is why former President and now Speaker of the House, Gloria Macapagal Arroyo’s leadership in the Congress is crucial as the champion for the economy. Marcos can become President as per Du30’s promise when he wins the election protest against Vice President Leni Robredo. This is very likely to happen after the appointment of the new Supreme Court Chief Justice, Teresita de Castro.

Downplaying but Ready

Bongbong Marcos is ready to step up as president and will prioritize good governance if he succeeds Du30. But he still is downplaying the President’s remark for him to be a Malacanang Successor.




The Economy is a Priority

The improvement of the economy with the consumer’s interest in mind is an objective. “I think the President is doing all of this tongue-in-cheek,” Bongbong Marcos comments. This is an answer of the president’s remark that if Marcos will be guaranteed to succeed him, he would willingly give up the presidency.

Toppling Corruption

“Return of good governance.” That is Marcos’ answer when asked what would be his top three priorities if he becomes president. He is saying that there is no need to name three things, just that we have to return to good governance. This despite the issues of massive graft and corruption that toppled his father.









PCGG Status

The Presidential Commission on Good Governance, created by Cory Aquino, had the sole purpose of prosecuting the Marcoses. It aims to recover the vast amount of allegedly ill-gotten wealth from the Marcos family and their allies. Cases have been filed by the PCGG but to this day none has prospered, as Marcos explains.




Moving on after Election Protest

Now, the Congress is now planning to abolish the PCGG. This is taken by the Marcoses as a sign that the country has to move on. Imee Marcos made a speech about moving on to which she was criticized by Bam Aquino. Bongbong Marcos insists that they have nothing to be sorry for. Instead, Marcos believes that it is their duty to continue on his father’s blueprints and lead the country once more.

Can Supreme Court Chief Justice De Castro be Instrumental in Bongbong Marcos’ Protest Win in Two Months?

Now that Pro-Marcos Teresita de Castro is the Supreme Court chief justice, the yellow officials and their supporters can only hope for divine intervention. That if their wishes are favored by the higher-ups.  However, de Castro only has less than two months to strengthen her predecessor’s system since she retires on October 8. She explains to the Judicial and Bar Council that her short-term would not get in the way of her effectiveness as chief magistrate. Can she possibly balance the biases against Bongbong Marcos that prolong his electoral protest against the questionable Vice President Leni Robredo?

A Lot to Accomplish in a Couple of Months

Tenure has always been respected by the Supreme Court as the institution’s culture. The appointment of the junior justice Maria Lourdes Sereno as the chief justice did not surprisingly cause issues despite overpassing the more senior contenders. De Castro accepted Sereno’s Presidential appointment at the time of ex-Pnoy. She said that there’s nothing she can do about it. This time, she’s confident of all the years she has worked to be able to accomplish much within the 2 months that she’ll have.




Very Qualified as Supreme Court Head

De Castro has been working in government service for 45 years now. She has only started out then with clerical work for the High Court and then rising through the ranks. With the Supreme Court, she has served for already 11 years. She also has experience serving at the Department of Justice as well as being the presiding justice of the Sandiganbayan.

 

Project Takeover

De Castro is now carrying on the work of digitization started on by the former CJ Sereno. The Enterprise Information Systems Plan has always been Sereno’s pet project and now De Castro is continuing this. This is a joint endeavor by the Supreme Court and the Presidential Communications Development and Strategic Planning Office(PCDSPO). The project covers the country’s executive issuances, laws, and jurisprudence. Once completed, the records will be publicly available through the Official Gazette and the Supreme Court Library.








Majority Approval

De Castro have the most approval within the judiciary among those shortlisted for the role. Associate Justices Diosdado Peralta and Lucas Bersamin were the other people who were shortlisted. The only sentiments against De Castro would be the unnecessary expense of her appointment. She would have a bigger compensation as chief justice as well as an enhanced retirement package for only completing 2 months of service. That can be a challenge for her to do what she has to do in a very short time.




The SolGen Approved of the Appointment

Quoting Solicitor General Jose Calida,  “We are elated because her legal brilliance, competence, fairness, and integrity ensure that justice will be well-served during her tenure.” The solicitor general certainly believes that De Castro truly deserves this appointment. Calida was instrumental in the removal of Sereno through his quo warranto petition that confirms that the former President’s appointee was not qualified for the job as voted by the majority of her fellow magistrates. De Castro can only work for the benefit of the public as per the mandate of the current President. That should be very alarming for the opposition right now.
