SolGen: It is within PET’s jurisdiction to declare failure of election but not to call for a new election.
The SolGen’s Comment
Solicitor General Jose Calida who is known for his wisdom in implementing the laws of the land put a sense into the VP protest of former Senator Bongbong Marcos. This is by far the biggest pressure on the Supreme Court when it comes to Marcos’s VP protest against Leni Robredo. Calida’s expert opinion is in line with the insight of the protester’s lawyers. He said that the Presidential Electoral Tribunal (PET) has the jurisdiction to declare a failure of the election but not to call for re-election.
Proofs of Fraud
The Supreme Court magistrates that compose the PET did not make a ruling on Marcos’ protest yet. His first and second courses of action are still pending. Instead, the minority seek the comments of the parties for the 3rd cause of action. The increase of Robredo’s votes after the recount did not matter. This is after proofs of fraud plus harrassment and chaos during elections dominate social media platforms. It in fact serves as the evidence of the discrepancy between the automated results versus the manual counts. So, it is clear that Robredo’s winning number of votes is questionable.
The 3rd Cause of Action Relevance
Robredo’a 477,985 votes in Lanao del Sur, Basilan, and Maguindanao against Marcos’ 169,160 votes can vanish easily. To annul the votes from these provinces would immediately make Marcos the winner of the 2016 VP elections. Since it’s only less than a year left for his term, his supporters are hopeful that he can get justice from the 2016 election fiasco by becoming the new president in 2022.
