Cayetano-Marcos: A Jurisdiction Conflict or Just Hating Each Other’s Guts?

An Overlapping Situation

Senators Pia Cayetano and Imee Marcos continue the rift between their families. In 2016, Senator Ian Peter Cayetano and Bongbong Marcos also had some bouts. A recent hearing that tackles the the “economic effects” of the government’s investment promotions program has led to Citira. Cayetano is the sponsor of the Senate version of Citira, which is under her ways and means committee. She fumes over Marcos’ inclusion of this topic on her economic hearing.

Cayetano’s Dissatisfaction

Malacanang certifies the CITIRA bill as urgent, according to Cayetano. The bill is now up for plenary debates as Committee Report No. 50. Are we allowed to have another committee conduct a hearing on exactly the same subject matter in another hearing without even informing the chair, even on a personal level?” Cayetano said in the plenary session. “I don’t mind, dear colleagues, you can speak to any resource person. You can invite them to your office, but to have them in a hearing on a matter that was pending on the floor is a slightly different thing,” she continued.

Apology to the Irrate Senator

This prompts Marcos to clarify that the Senate economic affairs’ hearing did not touch on the tax aspect of the CITIRA measure. It merely tackles the impact of COVID-19 on exports and the Business Process Outsourcing (BPO) companies. Marcos added that the discussion also includes the impact of the cancellation of the Philippines-U.S. Visiting Forces Agreement (VFA) and the over-all effects of COVID-19 on the economy. Marcos eventually apologizes to Cayetano and Cayetano accepts Marcos’ apology but has difficulty understanding her explanation that the committee covers a wide range of topics.

Bongbong Marcos Grateful of President’s Trust, Speeds Up Election Protest

It is heartwarming for Bongbong Marcos to hear it from the President that should he is the Vice President, he could have resigned already because of too much pressure. It should be the younger ones who must face those kinds of challenges like the namesake and Cayetano. Marcos responds by urging PET once more to speed up the process of his election protest against Leni Robredo whom the President thinks that she’s not capable enough.

Marcos’ Strategy

Marcos seeks the immediate decryption of ballot images from the clustered precincts of 30 contested provinces. He also asks the tribunal to print the ballot image from the Secure Digital cards. The other data storage devices from each of the 36,465 protested clustered precincts must be included. This should be done before the scheduled preliminary conference on June 21.

Comelec Supervision

Lawyer George Garcia argues that PET has the power to order the decryption and printing before the scheduled preliminary conference to expedite the proceedings. The process, as per the rules, is to be conducted and supervised by the election records and statistics departments of the Commission on Elections (Comelec).

PET Rules

Rule 29(a) of the 2010 PET Rules enumerated the items to be considered during the preliminary conference. This included other matters that may aid in the prompt disposition of the election protest. They may be something that would “assist in the preparation for the recount proceedings and the presentation of evidence for the election protest.

Anointed Successor

President Du30 adds that he is confident that the country is in good hands if Marcos or Cayetano succeeds him as president. He also insinuates his distrust to Robredo because he is not certain where she plans to take the nation to. Marcos recognizes this and comforts the president by saying; hang on in there, Mr. President, the truth will finally come out. We are doing all we can – not to allow any delay in the process anymore.

Rally to Oust Leni Robredo from VP Post Successful Despite Media Indifference

The April 2 “Palit Bise” or Change VP rally organized to out Leni Robredo already have between  4,000 to 6,000 people an hour before the official time at 4:00 PM. It quickly multiplied in number until midnight or so. The images can tell the total estimate of the crowd since there’s still no official head count at this time. Many mainstream media are also indifferent in such news – which is evident that Liberal Party still controls the country through media.

Pro-Administration Rally

Supporters of the President gathered on April 2 to call for the impeachment of Vice President Leni Robredo. Pro-Du30 lawyer Bruce Rivera said, that Palit Bise is an indignation rally of the people and not administration-backed activity. It lasted until 4 PM with full entertainment and attended by personalities from show business.

Own Publicity

Rivera announced the activity in a press conference. This is in connivance with his group “Impeach VP Leni Team.” The impeachment plan against Robredo is allegedly for “peddling lies” about the Philippines to the international community.

People’s Initiative

According to Rivera, the April 2 rally is not for politicians but for the people. It’s an event for the Filipinos people for unity against the Vice President and other Presidential appointees who are giving a bad name to the president, said organizer, Jimmy Bondoc.

Recount is a Must to Oust Leni Robredo

The organizers of the rally believe that there’s no need to impeach Robredo because she’s not the real Vice President – but the electoral protest is so slow. Impeachment is the fastest way of getting rid of her. The crowd is big enough but it can be bigger if the Binay, Honasan, Marcos and Du30 groups unite to ask SC to fast track the recount. This can happen if organizers clearly define that they want Bongbong Marcos to finally take over the VP seat that the majority of Filipinos voted for.

Taguig’s CA Favor is Not for Ownership: Binay-Cayetano Fight Continues Over BGC

Makati Mayor Abby Binay clarifies that The CA does not rule that Taguig is the rightful owner of the BGC or Bonifacio Global City. The Court ruling that Makati, not Taguig, is the rightful owner of the BGC is not changed with the latest CA decision that finds Makati’s forum shopping offense.

Ruling about Makati’s Forum Shopping

The Court of Appeals or CA grants the motion of the Taguig City government to dismiss Makati City’s earlier appeal because of forum shopping. It revives the legal battle of who owns Fort Bonifacio. The March 8, 2017 decision says that the CA through the special sixth division rules that Makati commits forum shopping when it filed the same appeal before two courts. CA Ruling is not about BGC Ownership

Taguig Mayor Lani Cayetano hails the CA decision as a victory for Taguigeños. She said that the latest CA ruling “essentially put Taguig as the rightful owner of the contested estate.” Makati Mayor Abigail or Abby Binay said that Cayetano’s statement is wrong because the SC never said Taguig owns Fort Bonifacio. It only rules that Makati is guilty of forum shopping with two similar cases filed in two courts.

Ownership Case is Not Dismissed

The order of the case dismissal by the CA confuses the decision of the SC. The Supreme Court only orders the previous lawyers of Makati to pay a fine and not to dismiss the case. Makati swears to use all legal remedies to protect its territorial claim,” Binay added.

Recent Developments of the Case

On July 30, 2013, the CA rules in favor of Makati and reverses the Pasig court ruling. The CA lifts the injunction earlier imposed on Makati and orders Taguig to cease and desist from exercising jurisdiction over the area. Taguig fights this decision in a motion and argues that Makati commits forum shopping. Taguig filed a motion both in the CA and the SC. On June 15, 3016, the SC favors Taguig and found Makati guilty of forum shopping. Recently, the CA issues the same ruling as the SC but specifies the forum shopping issue only that has nothing to do with ownership. Therefore, BGC remains under its original owner which is Makati that is being contested by Taguig.

Cayetano defended drug war of Philippine President on CNN Breaking News

Christiane Amanpour, CNN International anchor for CNN Breaking News that feature the running mate of Philippine President Rodrigo Duterte, Alan Peter Cayetano who did not make it to the Vice Presidency for obvious reasons as per the interview – already explained to Cayetano that the same bloody strategy on the war on drugs was already implemented in Thailand and Mexico – but to no avail, but Cayetano in his lack of experience for general governance was still hopeful just to show defense in favor of Duterte. The CNN interview went:

“Are you sure this (war or drugs) will work?” Amanpour asked.

“We hope so, we’re praying so we are just trying to instill in the people the love but also the fear of the law,” Cayetano said.

He added, “as to casualties as I said in a perfect world no one should die.”

Of the 2,000 death toll as of Tuesday, the Philippine National Police said 895 suspects were dead and 1,100 deaths are still under investigation according to Chief Ronald dela Rosa. So, it is just bias that Cayetano took it as “bearing fruit” when there are more suspicious deaths than the actual illegal drug casualties.

“We have three to seven million Filipinos who are hooked on drugs, three million who are addicted to it,” Cayetano said. “Something has to be done and our President has started to do something about it.”

“What do we tell the critics? Please come here, don’t just read the reports because there are people out to discredit him (Duterte) that are using the words extrajudicial killing, summary killing, vigilante killings very loosely,” Cayetano added.

De Lima gained allies vs drug war of Philippine President from CNN Breaking News

Despite the fear that the Duterte administration has instilled to Filipinos, a brave lady senator stood up against him even if he went below the belt in maligning her character. Senator Leila de Lima said No to killings in any kind. Her words during the CNN Breaking News with Christiane Amanpour were: “How can anyone say that there are no extrajudicial killings? We have no more than 2,000 dead bodies, dead persons in the name of the so-called war,” De Lima said in a separate interview with Amanpour.

While she understands the magnitude of the country’s drug menace, De Lima earlier said, “we cannot wage the war against drugs with blood” as seen through CNN Breaking News.

The senator was the previous Justice secretary and all the Philippine President can do is to spread rumors of her edited sex video and alleged affair with her driver.

Senator de Lima was confident despite the President’s attacks: “I know what the truth is and the truth is on my side,” De Lima told Amanpour.

De Lima suggested to intensify the campaign against illegal drugs but “with the least number of killings or without.”

“Yes there are still a lot to fix in our criminal justice system so let’s fix it. Let’s fix the law enforcement, let’s make it more efficient,” she explained.

De Lima knows that law enforcers should be trained and there’s a need for more prosecutors. “There should be no shortcuts in trying to achieve law and order in our society;” as per CNN News. Certainly, de Lima’s principles are in line with the international bodies who witnessed how Duterte’s strategy failed before.

Who Knows? Cayetano can be best friends with Nancy Binay, Trillanes

Allan Peter Cayetano seems to just laughed at the unexpected seating arrangement when he was in between Senator Nancy Binay and Trillanes during the resent senate session. He was even laughing with the lady senator. Can this be the start of a reconciliation now that the election is already over? President Rodrigo Duterte would have liked that if that is the case as he himself is a good friend of former Vice President Jejomar Binay. Indeed, this could be a way towards healing the country. Read this:

GMA reported: Am I being punished by the Senate? Sen. Alan Peter Cayetano jokingly raised this question Tuesday as he found himself seated in the middle of Senators Antonio Trillanes IV and Nancy Binay. He asked if he is not punished then it should be his seat mates were being punished.

Binay is the daughter of former Vice President Jejomar Binay whom Cayetano criticized for alleged corruption during his stint as Makati mayor. Cayetano, together with Senate President Aquilino Pimentel III and Trillanes, pushed for the Senate probe on the matter. Trillanes, on the other hand, had a rift with Cayetano when they both sought the vice presidency. Trillanes also scored Cayetano for defending his then runningmate, now President Rodrigo Duterte.

It added: Cayetano said he and Binay laughed over their situation. Asked if he would asked to be transferred to another seat, Cayetano said: No need as they have transferred already. Binay, meanwhile, told reporters that she was surprised with the seating arrangement.

Hilarious…Binay said. Do you know who my seat mates were? I’m ready but it seems that the two have not moved on yet; Binay joked. The seating arrangement will still be changed as Trillanes will be transferred to another seat being a member of the minority bloc.
