Popular bet for Senator, Gov. Imee Marcos and the very supportive sister of Bongbong Marcos defends their lawyer, Atty. George Garcia in speaking in front of the media. She said that Garcia is so careful about what to say so as not to disobey the gag order. While VP Robredo’s camp via her legal adviser, Atty. Freshly Made Wet

Gov. Marcos can’t help but flash her lovable smile when she stresses that the wet ballots are freshly made. They do not look like they were affected by the typhoon last December and until this April, they are still wet. Macalintal earlier said that it was normal because of the bad weather last year.




Weatherproof Ballot Boxes?

Marcos, who is running for Senator questions the so-called weatherproof ballot boxes. If they really are what they should be, why are they made of plastic, with masking tape around, and most of all wet?




Excess Ballots

Marcos added that excess ballots are normal in an election. This happens when the elderly made mistakes in filling up the form, accidentally wet and the ballot becomes eligible to read. However, if they are freshly made wet, then that’s another story.




Why is Macalintal so Defensive?

The audit logs do not contain a tally of votes, which is the subject of the recount. Thus making their disappearance a “technical defect” that “can never affect the genuineness and accuracy of the count,” Macalintal said. Ballots in previous elections were also not safe from typhoons and floods. This is not a cause for concern because of the ballot images of the automated system, he added. So, what is the purpose of the weather-proof ballot boxes then? Does he insinuate to use the encrypted images that Bongbong Marcos is still asking for the PET to give him copies after paying over 7 million Pesos?

Early Anomalies on VP Recount Observed by Bongbong and Imee Marcos

Bongbong Marcos as seconded by his sister, Gov. Imee Marcos discloses that while the Bato, Camarines Sur ballots are gathered for the recount today, some are wet. In other boxes,  the audit logs are missing. Finally Happening

The recount finally happens two years after Marcos brings his electoral protest to the Supreme Court that sits as the PET. He lost to Robredo by a slim margin of 263,473 votes. The PET earlier announces that if there’s not enough discrepancy in the pilot provinces, the electoral protest of Marcos may end there. His chosen areas are Camarines Sur, Iloilo, and Negros Oriental, Robredo’s bailiwicks.




Early Anomalies of Recount Explained

Former Senator Marcos explains that the ballots that are wet are set aside. The sabotage act cannot happen two years ago. Someone may have the splash just prior to today’s event. The audit logs are also essential to determine the transmission date of the report.




Words from Robredo’s Camp

Atty Romulo Macalintal said that most electoral protests are not successful because the results of the manual ballot count tally exactly with that of the vote-counting machines (VCMs) and the consolidated canvassing system. However, Marcos’ protest is the only case that reaches this far in the national level.




Patience Counts

“We have endured two years of waiting due to Robredo’s habitual and intentional moves to delay the election protest and deliberate attempts to bury the truth,” Marcos’ spokesperson Atty. Vic Rodriguez said in a statement.  Bongbong and Imee Marcos are in the Supreme Court in the early hours of April 2, 2018, to visit their supporters who are in vigil since February 7.

Philippine President Rodrigo Du30 hails the late President Ferdinand Marcos as a hero for many Filipinos. He stresses this during the former leader’s 100th birth anniversary. The opposition takes it as a campaign to rehabilitate the image of Marcos to help Bongbong Marcos’ political comeback. The younger Marcos’ election protest against VP Leni Robredo now results in a recount on March 19. He earlier discloses evidence of massive digital frauds. Now Atty. Romulo Macalintal appears to be lawyering for the Comelec. He claims that the squares are a new feature – that the parties apparently know of. He refers to the presence of the squares in the ballot images. Marcos’ spokesperson then dares him to produce any briefing made by the Comelec on the presence of the squares. Macalintal has not replied up to this time of writing.

Same Accusations

Duterte, who faces the same accusations of major human rights abuses as Marcos, is a friend of the Marcos family. His detractors said that he plays a key role to bolster their efforts to regain the top echelons of political power. Marcos stepped down in 1986 to avoid bloodshed during the EDSA revolution. He died in exile in Hawaii three years later after the late President Cory Aquino disallowed him to return to the Philippines. He wanted to explain the alleged hidden wealth but Aquino refused. His enemies continue to accuse him of embezzling billions of dollars during his rule. That turns out to be a security seal for the welfare of humanity. Now, they aggressively launch a black propaganda against Du30 for the same reasons.



The President’s Dare to Resign

In October last year, Duterte dared Sereno and Ombudsman Conchita Carpio Morales to resign with him, saying the two had allowed themselves to be “used” in the corruption allegations against him. Sereno is battling an impeachment complaint that alleged she had undeclared wealth and betrayed public trust, among others. House lawmakers are expected to resolve within the month if there is probable cause for her impeachment.



Supreme Court CJ can be Fired

Leyte Rep. Vicente Veloso, vice-chairman of the House Committee on Justice, said Sereno only submitted one of her Statements of Assets, Liabilities and Net worth (SALNs) to the Judicial and Bar Council when the panel was deliberating on the new Chief Justice in 2012, despite a notice from the council directing applicants to submit all of their SALNs. A decision from the Supreme Court in 1963 established that “if at the time of appointment, petitioner did not have necessary qualifications for the office…then he did not have the right to be there,” said Veloso.




VP Electoral Protest Update

Marcos’ lawyer emphasizes that Macalintal is just being consistently untrue or he had a special briefing from Comelec exclusively for the then ruling Liberal Party. Either way, the existence of the square is an unlawful insertion and alteration of the digital image. Their excuses are so feeble and insulting to the intelligence of the Filipino electorate as it provides them too little too late, said Atty. Rodriguez. The squares should not be there because, during the source code review, no boxes were shown. If ever, the boxes must have been added after the source code review which is against the law, he added.

Marcos Camp’s Counter Claim

The legal counsel of Marcos counters the claim of Vice President Robredo’s lawyer that Marcos was “ill-advised” over his allegations. This is concerning the ballot images in the electoral protest. Marcos’ spokesperson Vic Rodriguez maintains that square marks in the ballot images from Camarines Sur and Negros Oriental that his client previously publicized should not be there in the first place.



Misleading the People

Another “yellow” election lawyer Emil Marañon III supports the explanation of Macalintal. He is one of the counsels previously consulted by the Vice President’s camp. He is not an IT expert unline Atty. Glenn Chong who technically verifies the facts presented by Marcos in a press conference.



Questionable Features

The Vice President’s lawyer, Macalintal retaliates with a press conference to explain that the squares are merely among the new features of the ballot introduced in 2016. However, many IT experts can attest that these can be signals to transmit a defaulted report.

“They have trampled on the right of the Filipino people and deprived them of their duly elected vice president. Now two years on, they are continuing their web of lies even in the face of direct and solid evidence of rampant cheating,” said Rodriguez. “This is the grandest and longest deception ever committed against the Filipino people,” he added.

President Rodrigo Du30 tells his son, Paolo, to “do what is right.” This is after the then vice mayor of Davao City informed him of his resignation over family and political issues. Meanwhile, the initial review of ballots in Camarines Sur, VP Leni Robredo’s home province is fast approaching. Its retrieval is on January 22, 2018. The recount schedule is in the second week of February. The Vice President can never go wrong if she follows the same advice on Bongbong Marcos’ election protest against her.

Vice Mayor Du30 announces on Christmas day his resignation to his constituents out of “delicadeza” or sense of propriety. He basically had enough of the “shabu” smuggling accusation and his twitter arguments with daughter Isabelle just add up to the mess he’s in. His father, however, clarifies that he never suggests for it. He believes that the highly criticized pictorial of his son’s daughter in Malacañang, and other past issues made him vacate his post.




VP’s Lawyer Seems to be on Top of Her

Robredo’s lawyer, Atty. Romulo Macalintal stresses that under the PET Rules if Marcos cannot prove any substantial vote discrepancy from the three pilot provinces, his protest is for dismissal due to lack of merit. For Camarines Sur alone, Macalintal reminds Marcos that P9.6 million is chargeable from his cash deposit for the retrieval expenses. The lead counsel’s confidence obviously gives her the courage to continue the fight even if she can’t pay the remaining 7 Million Pesos balance for her counter-protest against Marcos.




The Protestant’s Stand on the Election Protest

Bongbong Marcos laments that it takes for the PET more than 17 months to get to the recount stage. That can also take another 7 months. So, 2 years is almost gone for the 6-year term by the time a ruling can be made granting that there’s no more delay. Nevertheless, Marcos’ protest is the only national case that has gone that far. Robredo should also think of saving herself if the tide does not turn into her favor by then.

Bongbong Marcos’ Motion is Not to Delay Protest but Stop Robredo’s Abuses

Bongbong Marcos recently filed the motion for reconsideration after the PET allowed Robredo to have copies of decrypted ballots. These are from the secured digital (SD) cards of Camarines Sur, Iloilo and Negros Oriental. VP Leni Robredo’s lawyer, Romulo Macalintal calls this  “unnecessary.” He added that if Marcos really wants to get a speedy resolution of his electoral protest, he should refrain from doing so. However, professionalism dictates that if something is not agreeable, a motion must be filed for the record. Abuses of the law can then be very clear in the end. Media stunts come and go but official records stay.

Passing the Blame

“By doing this, they have no one to blame but themselves for any delay,” Romulo Macalintal said. The lawyer refers to the partial motion for reconsideration filed by Marcos. He questions the decision dated Nov. 7, 2017, of the Supreme Court that sits as the Presidential Electoral Tribunal or PET.



Normal Practice by Spirit

“Like in any other case, both camps are given copies of all documents. This is the standard practice in the spirit of transparency and fairness,” Macalintal said. He explains that the soft copies can help both parties protect their rights. Marcos earlier questions such explanation because if Robredo’s Camp really believe in it, why did they block it and not help pay for the process?

The PET approves the urgent ex-parte motion filed by Robredo’s camp last Oct. 23. That she be furnished soft copies of the ballot images and reports in a decrypted format from the three pilot provinces of Marcos for his election protest. This despite the latter’s disagreement.



Stop Robredo’s Abuses

Meanwhile, Atty. George Garcia of the Marcos Camp can only shake his head on the many cases of abuse done by its rival Camp. First, Robredo expressed her fear that Marcos might steal her seat. Demonizing him once more using his father’s black media propaganda initiated by her party. Second, she has not paid fully for her counter-protest against Marcos but SC tolerates her so far. Lastly, but not the least or limited to it, she has the most motions filed dubbed as a dilatory tactic to drag the protest further. Macalintal is obviously just passing the blame on to Marcos.

Closure or Disunity after Protest?

The recount scheduled for February 2018 can either bring closure or more disunity depending on how it is processed. This is in connection with Bongbong Marcos’ election protest against VP Leni Robredo. Clean election advocates already scrutinize the ballot retrieval process of the pilot provinces namely; Camarines Sur, Iloilo and Negros Oriental.




Robredo’s Territory First

Macalintal said that the first ones to count are the ballots from the clustered precincts in Camarines Sur. It’s the vice president’s home province. The ballot retrievals are set on January 22, 2018. The recount should start by the second week of February. This two other pilot provinces can then follow.



Marcos’ Choices

The Supreme Court that sits as the PET, begins in February 2018 the recount of votes. It covers the three pilot provinces of Camarines Sur, Iloilo and Negros Oriental. Marcos chooses them as the best provinces. He’s certain that he could prove the irregularities alleged in his protest there.








Did not Pay a High Price to Lose

If Marcos could not prove any substantial recovery of votes from these three pilot provinces, his protest will be dismissed for lack of merit. This is under the PET Rules, Macalintal said. In Camarines Sur alone, P9.6 million would be charged to Marcos’ cash deposit for the retrieval of ballots, salaries, and allowances of employees, security, transportation, and other expenses.

Macalintal is Ahead of the Supreme Court: VP Recount to Start in February 2018

Atty. Romulo Macalintal visited the recount area at the Supreme Court recently and said that the manual count is expected to start in February 2018. They want this done and over with. Hoping to erase doubts on VP Leni Robredo’s victory over Bongbong Marcos who filed the electoral against her. 2nd Week of February

The ballot recount requested by Bongbong” Marcos is to start on the second week of February. This is according to Romulo Macalintal, lawyer of Vice President Leni Robredo. In a statement, Macalintal said that the Supreme Court would start collecting the ballots in Camarines Sur on Jan. 22. It sits as the Presidential Electoral Tribunal or PET,




Marcos’ Priority Areas

Marcos chooses three pilot provinces – Camarines Sur, Iloilo and Negros Oriental for the initial recount. His camp earlier explains that these would be the “best provinces.” These are where he could prove his allegation of electoral fraud in the vice presidential race.



Macalintal’s Confidence in the Supreme Court

In an ambush interview at the Supreme Court, Macalintal expressed confidence that the recount would push Marcos’s electoral protest towards dismissal. Of course, Marcos can only retaliate as it happens. The Counter-Protest must be decided first after Robredo failed to pay her 7 Million balance on time.








No Revisions Before Until Now

Macalintal explains that out of around 500 candidates who protested in local elections have not shown any revision. However, Atty. George Garcia of the Marcos Camp earlier stressed that Marcos’ electoral protest is unique in its own rights. It is the only protest at the national level who has paid in full. If this is just Robredo’s media stunt, she can easily burn to her extinction.

Bongbong Marcos’ lawyer George Garcia said that the Comelec should start to conduct a bidding process for the next election in 2019 already for suppliers of automated election machines. He adds that the result of Marcos’ electoral protest against Leni Robredo can even help in determining if there are no revisions to the actual vote counts compared to the machine-generated results. Atty. Romulo Macalintal of Robredo’s is obviously uncomfortable upon hearing this.

Early Resolution of Election Protest

The early resolution of the Marcos-Robredo election protest can affirm the credibility of Comelec and even Smartmatic if Robredo wins. If it is the other way around, then it’s about time to change the supplier. Garcia stresses that it’s better to look for options already early on so that decisions won’t be last minute. That can end up in selecting only the available choice and not the best if Comelec won’t move now.




Any Result is Acceptable for Marcos

Marcos may want to win the protest but if it won’t work in his favor, it’s also acceptable. What’s important is to expedite the recount to know the real score. Comelec should take advantage of having this opportunity to clear their name from doubts that they have a hand in the alleged fraudulent 2016 elections.



Macalintal’s Response

Macalintal mocks the IT experts who give their expert opinions on the transmission trend and server behavior when the immediate twist of fate started on the night of the May 16, 2016, VP race.  This is in contrast with Clean Elections advocate, Atty. Glenn Chong’s statement that says that the fraudulent activities during the latest national elections were not only manual but digital in nature. Aside from being a lawyer, he also has some IT background. Not to mention the witnesses of Pastor Boy Saycon in the Senate on the alleged rigging incidents involving system redirecting for questionable servers.








Assessment And Evaluation

Section 33 of RA 9369 states that the JCOC  must monitor and evaluate the digital election system within six months from the date of the election. Comprehensive assessment and evaluation of the AES technologies must be the basis for the appropriate recommendations to Congress.”

Lawyers Romulo Macalintal and Bernadette Sardillo’s recent accusation against Bongbong Marcos over his list of election fraud witnesses failed miserably. People are just stunned by the response of Atty. Vic Rodriguez from the Marcos Camp. Eventually, lawyers should know who qualifies as such. Social media comments go to the line of criticizing her camp to be as dumb as ever.

Resolution on BEI Requirement

The Section 5 of  Comelec Resolution No. 10031 is misleading. Former-Comelec chairman Andres Bautista signs this. It cites that a person must be “a registered voter of the city or municipality.” This is to become a member or chairperson of the BEI. It has nothing to do with a witness’ qualification.




Disqualify Poll Officers First

Rodriguez said Robredo assumes that the poll officers they presented on their list are not qualified. As a lawyer, she should present proof that those whom she claims to have served as BEI’s are disqualified. It is unlawful just to resort to the spread of fake news. Irresponsible and false statements can backfire on them, the lawyer said. “Assuming they are indeed not qualified, Robredo should be reminded that it was ‘her own COMELEC’ then led by its impeached head, Andy Bautista, who appointed them, and not us,” he added.



BEI Witnesses Need not Be Precinct Voters

Board of Election Inspectors (BEIs) are not expected to be registered voters to the precincts they are serving or have served. All BEIs are only required to be registered voters. This is Rodriguez’s response after the camp of  Vice President Leni Robredo, calls Marcos a liar over the list of witnesses for his election protest from Lanao del Sur, Maguindanao, and Basilan.

Immediately after the shameful event, the questionable VP disappears from the media scene. Supreme Court Chief Justice, Maria Lourdes Sereno takes over her spot in the limelight. This has to do with the ongoing Congressional hearings on her impeachment.
